If you're on the waiting list for social housing, how likely would it be for you to be allocated something suitable if your LL evicted you officially?0
-
Is the landlord aware that they are making you uncomfortable? If not, you should talk to them.
Is the landlord doing something that's illegal? If so you should take proper legal advice.
Without knowing any details, we can only really guess.0 -
My apology for inferring that the issue was the payment of rent, you had indeed stipulated that you did pay on time.Less a case of flexibility more a case they've been pretty disinterested until now. Not a rent issue that's always paid on time.
Pixie, by flexibility I referred to OP use of the world 'relaxed' no implication at all to the status of HB claimant.
OP, it is difficult to understand without knowing how he is making things difficult for you. There could be many reasons why he is becoming more interested. Maybe he has another property that he rents and has just had a bad experienced with the tenant, being taken to court, or trying to evict and not succeeding because of failure to follow the correct procedures, so he is now more careful, or just having heard of such experience from a friend, or watching a TV programme.
The issue is how being more 'interested' it is making it difficult for you to remain in the property.0 -
Did I miss what the LL was actually doing?0

I was in a situation with my LL where for 18 months he told me he wanted to sell the place and just left that hanging over me. It was always going to be difficult to find another place because i too was on benefits so although today (then) we had somewhere to live.. , I was pretty sure at some time in the future there would be a complete nightmare. I found it very stressful, even though right there and then we were ok. In some ways I would have preferred to have it happen sooner rather than later. It really did affect me and my health.
So I do sympathise.
Be aware that if the LL does want to evict you, he has to serve a S21 then get a possession order through the courts then apply for a bailiffs order. From start to finish this process takes 3 months, depending on court waiting times in your area and the efficiency of the Ll, it can take a lot longer. The LL hasn't served a S21 yet so you are still looking at some time.
With my area, LHA was £750, rents were £1,100, (i.e. I couldn't possibly pay what other places were being rented for, obviously the LL wanted to maximise his income or sell, I can understand that). I couldn't move areas (to chepaer areas) easily with two kids with special needs who don't travel well (one collapses in strange places, the other just gets hysterical) so it wasn't a good situation to be in. Because of the difficulty in finding a new place I did, at the LL's request decorate the place to attract 'other LL buyers'. Of course this was completely stupid of me. I knew I was being a mug but was so desperate I'd have done almost anything to avoid eviction. I'd advise you to remember that for the LL this is a business, for you its your home so there's always going to be a problem with different expectations.
And I am afraid, some LL's lie. Some LL's assure you that what they say is legal when its not. And I am afraid, the council aren't always any better. Get advice from experts (like Shelter) every step of the way.0 -
CAB, and Shelter sound like good places to start, the advice here about legal process is good, but I think there would be an extension to that time due to children involved and your mental health issues? Local council must be able to advise as well. I know you probably don`t want to hear it just now but a savings fund, built up monthly bit by bit, is a great psychological crutch in these sorts of situations. I wouldn`t broach any conversation about rent, in these times of benefit cuts and Brexit concern landlords will be looking to take rent cuts not rises. IMO.0
