Parking Charge from UKPC

I am the keeper, not the driver. It is the first parking ticket for both of us and we obviously don't want to pay it. It was in the car park at one of birmingham city council flats.
The parking charge from UKPC is dated 31/12/16 @ 10.56pm (windscreen ticket). The full charge is £90 but the reduced charge is unclear (it is printed ontop of other text). There is no way anyone can tell what the reduced charge amount is on the ticket. Everything else on the ticket is clear.
They have evidence (photos). The evidence shows the sign but it is way too dark (not because of the camera, but because it was actually that dark). The evidence is also extremely blurry so you can't actually see what the sign says at all.
I have read the NEWBIES thread and I just want to make sure I understood what I need to do and have a good chance at appealing otherwise I'd pay it off now (whatever the reduced charge is).
1. I wait until day 26 (which is 25th January '17) and make an appeal online via their website - If I understand correctly, the template to use is "Template appeal for BPA members".
2. If they reject my appeal, then I appeal to POPLA, which is the "SECOND STAGE APPEAL - POPLA OR IAS" section. My grounds would be "Signage", "No driver liability", "Landowner Authority (if I don't get it from them in the appeal)" and "No keeper liability (if I don't get an NTK by day 56)".

You are absolutely spot on with 1 and 2. It will be a PoPLA appeal because the scammers are BPA members. The pay it now bit I don't understand, as MSE assisted PoPLA appeals always win against UKPC as long as you follow the advice on this forum.
Well done on reading and understanding the process first time around. You will not believe the number of posters who start straight in with questions that are already answered in the NEWBIES.
Come back here if/when you get a rejection of your initial appeal and post up your draft PoPLA appeal before sending.
Obtain pics of the parking site, entrance and signage if you can. The signage pics UKPC use are generic and will probably not be from the car park in question. I've received the letter below today (10th May) from UKPC. Should I now appeal to POPLA via the link and use the "SECOND STAGE APPEAL - POPLA OR IAS" template - and use "Signage", "No driver liability", "Landowner Authority (if I don't get it from them in the appeal)" and "No keeper liability" as the grounds of appeal?Thank you for your recent correspondence in relation to the above Parking Charge.
We have investigated your appeal based on the information you have submitted and confirm that this Parking Charge was correctly issued because there are sufficient signs at the Civic Close warning drivers that should they park their vehicle without displaying a valid permit this will result in a Parking Charge being issued to the vehicle.
Our Appeals process is now concluded, you may now pick one of the following options:
1. Pay the parking charge detailed above at the reduced rate of £50 to UK Parking Control Ltd. PLEASE REFER OVERLEAF FOR PAYMENT OPTIONS AND ADDRESS DETAILS.
2. Make an appeal to POPLA – Submit an appeal online at ...popla.. within 28 days of the date of this letter using the verification code above. “Alternatively if you do not have internet access, you can send a letter to POPLA, PO Box 1270, Warrington, WA4 9RL within 28 days of the date of this letter using the verification code above.” Please note that if you wish to appeal to POPLA, you will lose the right to pay the charge at the discounted rate of £50, and should POPLA’s decision not go in your favour you will be required to pay the full amount of £90. If you opt to pay the parking charge you will be unable to appeal to POPLA.
By law we are also required to inform you that Ombudsman Services (...ombudsman-services....) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA, as explained above.
3. If you choose to do nothing the parking charge will automatically increase after 35 days from the date of this letter to £90 and the matter will be passed to our debt recovery agent, at which point you will be liable to pay an additional charge of £60, in accordance with our terms and conditions of parking, and further charges will be claimed if Court action is taken against you. Any unpaid Court Judgement may adversely affect your credit rating.0 -
draft a popla appeal by reading post #3 of the NEWBIES sticky thread and reading the examples and templates etc
use ALL legal arguments that you can , you only need 1 winning point to win outright0 -
What does your tenancy agreement say about parking? exact words please Have you informed your landlord of the fraulent behaviour of their contractor?

Did you ever get a NTK? If not, that will be another appeal point; no keeper liability as no NTK was received by day 56.
