pcn recieved 18 days after alleged offence

Hi all and a happy new Year
I have a question, when I was reading the pcn threads for advice I noticed that it states that a postal pcn without screen ticket dhould arrive within 15 days is this true as I have recieved one 18 days after the alleged offence and the letter was not sent until 16 days after the alleged offence
do I have a case here before I send them the letter set out in the forum

    you have a case IF the company state they are relying on POFa21012 , many do not

    the txt of thier letter my or may not refer to the POFa2012 , check before you reply

    The PCN/NTK has failed to meet the requirements of the POFA in order to transfer liability to the keeper. In other words they can (should) only pursue the driver, but PPCs are scammers and don't care about the law.

    You need to follow the advice in the NEWBIES thread and appeal using the relevant template letter, depending on whether the PPC is a BPA or IPC member. Add in, very carefully without giving away the driver's details, that the PCN/NTK has failed the requirements of the POFA 2012 by arriving too late to make the keeper liable, so they should contact the driver from now on or cancel. You will not of course be telling them who was driving.

    Do you mean T R Luckins Limited trading as UK Parking Solutions? There are many parking scammers with similar names so it is important to be precise.

    The one above is a BPA member so you would use the BPA template in blue from the NEWBIES thread id that is the case.

    Or is it one of these IPC members?

  • I have drafted the letter for an ipc company and added that they have failed to meet requirements set out in POFA2012 hopefully this will sort it

    Unfortunately it is believed that the IPC guarantee that 80% of appeals will be rejected automatically. Don't expect a win with your initial appeal.

    However the PPC would be daft to try this in court knowing they can't transfer liability to the keeper.
