ESA help

Hi can anyone help me? My husband has been on ESA for years now and he gets a small amount for me as his wife.

Please can anyone tell me if I can be removed from his claim? So I can start to sell some handmade things on EBAY?

I know he can go down permitted work route, but its me making them.

Any help would be appreciated.

    You haven't given anything like enough information to even make an educated guess.

    If you're reluctant to do so the CAB are very good at face to face advice.and overall benefit checks.

    There is no need to be removed from his claim. Your husband will just have to report your earnings which will then be taken into account on the payment. If he is in the Support Group, and has an entitlement to Contributions based benefit, he will continue to receive the single persons rate. If he is only receiving Income Based benefit you can't be removed from the claim as payment is based on household income.

    Thank you that makes perfect sense!!! It is income related. I will go the job centre and ask for some advice about doing a small part time self employed business. Thank you so much.:T

    Essentially, as you are aware, it can't be permitted work as you are doing it rather than your husband.

    In an income based ESA claim you will be allowed to keep the first £20 per week of earnings (this is after you have taken your expenses into account). There is some opportunity to average out these weekly amounts so that, for example if you make, in subsequent weeks £0, £20, £50, £0 you will not lose out in the high earning weeks. However how many weeks they average over needs to be agreed with DWP and the number of weeks will vary as your business matures.

    If you are also claiming carers allowance then you also need to be aware of their earnings limit - if you go above this (with allowances for pension contributions etc) then you will lose your carers allowance entitlement completely.
