Following the Rugby disruption 1/7/17 a friend told me they could only travel from London to X, arriving 3 hours late around 02.00, and were offered a paid taxi from X to Y, their original destination 20 miles further on, but were refused one from X to their home 15 miles away. This is not covered by NRCoT and is 'at our discretion' in the TOC Passenger Charter.They do have an obligation to get you home at night if the last train is cancelled0 -
The issue is that rail replacement transport is exactly that.
It doesn't matter if your home is half way and on a direct route even -the replacement system has to take you station-station.
I was told this was because of both public liability, hire service insurance and because any deviation from this rule would lead to other requests to have similar deviations made for others.
I believe the latter reason really.

28.1 If disruption prevents you from completing the journey shown on your Ticket, any Train Company will, where it reasonably can, provide you with alternative means of travel to your destination, or if necessary provide overnight accommodation for you."
So I was wrong to say the situation in #14 is not covered - I just didn't find it in as it is not in 'F Your Refund and Compensation Rights' but in 'E Making Your Train Journey'. And since these are minimum standards, the TOC in #14 seems to be at fault.0 -
Ah a more modern NCOC than I am used to I must admit.
Mind you, it's easy to say 'we'll get you home' but still stick to a station -station road replacement IMHO, i.e. the destination is the end rail station surely in contractual terms?0 -
While the NRCoT is intended to be contractual, it fails - imprecise, inconsistent and incomplete. I believe compensation to address failure of contractual performance is generally intended to mean practical steps to put the party in the position they should have been in. Thus arriving at a station at 01.00 facing a £10 taxi ride is not the same position as arriving at 22.00 in time for a £2 bus. Hence 'get you home or provide overnight accommodation'.... the destination is the end rail station surely in contractual terms?0
