Mis-sold TV (43x8309c)? - can i return for refund?

Bit of a long shot, but my parents bought a hi-spec Sony Bravia earlier in the year (March 2016) and were told by Currys that the TV had dual tuners and would record TV shows as well as having the new Android TV and YouView software - which would all arrive later in the year via a software update.
They have had several software updates but the the promised and advertised features haven't yet materialised. The only way to record tv shows is to disable all the android and youview software meaning i can't use the iplayer etc. It's either one or the other. This wasn't how it was marketed.
Does anyone know if there are any recourse to take the TV back and get a refund? I realise if it was 30 days after purchase it would be easier but several months down the line and the software update not doing what we were told seems to be taking the 'P'
a bit!!

Do you have any proof of what was promised? You say 'told by Currys' - realistically that boils down to your word against theirs. However you also say 'This wasn't how it was marketed' which may suggest the manufacturer advertised features. In this case you have a much stronger claim, assuming you can find some proof of what was claimed for the product.0

It all depends if you have visible proof that the feature would exist (say in a marketing flyer) on which they based their decision to purchase. Just because the salesman said so won't convince Currys! Also, having dual tuners does not necessarily mean they could be accessed simultaneously.
Sony support would be my first call and ask them if there will be any improvement.0 -
It's still on their firmware updates I assume so it's delayed . So possibly some comeback against Sony if it never arrives

Hi all and thanks for the quick responses,
The curry's marketing page for the product no longer exists. But I used the internet archive website to find the original spec on the sony site which shows the ability to record TV shows to HDD - dated may 2015
(im a new member so can't post URLs)
On the current version of this page, the same functionality comes with a note (see the small '2') which describes the issues i'm having:

Curry's may then have a claim against Sony but whether or not this is the case, this is of no concern to the OP's parents.0 -

I very much doubt a full refund of the purchase price will ever be offered regardless of what happens with the "promised" update.
If the software update never materialises, there might be a goodwill part refund offered, but your parents have had full use of the TV for nine months apart from a very minor extra feature.0 -

Not only that, but OP has no proof, other than a webpage from Sony, which isn't going to be enough.
Here is the Archive from 20th March 2016

So I am to understand, the TV currently has Android Tv, Youview and can record to HDD, but you need to disable the Youview?
I think you have no case, it does say in the spec
"Please note that HDD recording (REC) and satellite features will not be available when YouView functions are enabled."
So, I believe I am reading this right, in so far that it was marketed as this would be the way it would work. Sorry, but the only tangible evidence and the length of time means you won't get anywhere and better to look for other solutions (like standalone box/using the work around)0 -
Another point :Is the Currys bought model exactly the same one being described by Sony ?
I ask because Currys had their own version of the Panasonic I bought from Richer Sounds. It looked the same, but actually had a 1" smaller screen with a facility only found in the range above.0
