item delivered more expensive

i purchased a phone from john lewis just before xmas, it was delivered but although the delivery note was for the phone i ordered the actual phone was worth 3 x as much.. i contacted John lewis and told them of the error (honesty) . I asked if they could send me the phone i ordered in time for xmas, they replied and said they could not get the phone to me in time and "suggested i give the phone(the expensive one) as a gift and if they did not like it they would swap it.

the email seemed a bit vague so i wrote and clarified if i could keep the phone with no addition cost to me.

they then apologized and told me i was misinformed in the first instance and i am required to return the phone. they have offered me £100.00 to make up for the error and wrong info...however my wife did not get a present at xmas..

so the question is
where do i stand .do i return the phone after they said i could keep it but changed their minds, do i post it back and get the 100.00 or ignore their requests..
not only is this hassle but quite stressful
any advice would be welcomed

  • I think you should post back the phone, ask them to send you the phone you actually ordered, and use the £100 to buy something nice for you and your wife.

    That will resolve the issue once and for all. Ignoring it could lead to greater stress.

    Legally you have no right to keep the phone unless you pay for it. I suggest you ask JL for a pre-paid label to return the item and get proof of posting. Alternatively make arrangements for them to collect it.

    The £100 offer is generous in my view.

    Then just return the phone for a refund and take whatever goodwill gesture you are offered by John Lewis, you can't justify keeping it.

    So which is it?

    Just send the phone back and accept the extremely generous goodwill gesture of £100.

    Or don't send it back, lose out on the £100 then come back and ask for more advice when John Lewis chase you for the balance of payment for the more expensive phone you've kept.

  • After they first told you to gift the more expensive phone, you would have been in a perfect position to immediately sell it, buy the phone you wanted, and pocket the difference. Since you were honest enough to make sure they meant what they said, you now have to be honest enough to follow through.

    You're still £100 up on the deal though, which is nothing to complain about.

  • I wish this was the most stressful thing in my life - does a company offering good customer service really count as 'hassle' and being 'quite stressful' these days?
