LDK security parking ticket. Help!

I'm in need of some advice and would be extremely grateful if someone with more knowledge could help me with what to do next.

I parked in my local Lidlls at 7.30am on the 15/12/16 on my way to work to get presents for my class (I'm a teacher). The car park was practically empty as it was so early in the morning and I was in a bit of a rush to get to work. This company must be there waiting to prey on people because I've been sent a PCN letter through the post on the 22nd December claiming I wasn't parked wholly in a bay with picture evidence attached. I must have been like an inch out and think it's disgusting they can do this to people. The company is called LDK security group.

I have read conflicting messages on what to do next, whether to just ignore, or appeal. I am aware this company are a private company so do they have any jurisdiction to enforce this penalty?

I would very much appreciate some advice.

Thanks Tina.

clearly you have not read the sticky thread for NEWBIES , written by a teacher , near the top of this forum

if this was in england or wales, then IGNORE is incorrect since oct 2012 (so over 4 years since the new POFA2012 was passed for E + W)

so its appeal to LDK, and complain to LIDL CEO, a two pronged attack, especially if you can prove patronage of LIDL by receipts or bank statements

no private company can issue a penalty, so its not a penalty , nor is it a fine either

it is an INVOICE, which anybody can issue in the uk, TO ANYONE

IT IS A SPECULATIVE INVOICE , NOTHING MORE

they have 6 years to try an MCOL

ps:- if those dates are correct they may have breached their KADOE contract with the DVLA as they have to wait 28 days before seeking keeper details when not using ANPR

wait for further clarification on this aspect though
  • Thank you very much for the information it is very much appreciated.

Yep but have you now read 'NEWBIES PLEASE READ THESE FAQS FIRST'? Why do people post without reading that thread?

Hello, I'm new to this site and didn't know how to start my own thread, and not sure what people are referring to when they say to look at the sticky thread for Newbies so I will just ask my question here...

location of Incident - Gateshead/Newcastle UK ... In December 2016 I received a parking ticket for 'Obstructive Parking' from LDK security for £75 and the incident took place in early May that year so it took 6 months! to issue the parking notice, they attached photos of my van from the back and a back side angle shot (not showing the front or if anyone was in the vehicle). I'm a plumbing and heating engineer and the van is also stickered on the front back and sides, and I parked in a taxi rank as it was an emergency call out to a domino's nearby, also the taxi rank can fit 3 vehicles in and I was the only one so I wasn't Obstructing anyone, also it was that long ago I wasn't sure if I left a colleague in the van who could move it if needed, I was only about 10 minutes in the store as the manager said I could bring the van around the back of the store which is their private place for delivery drivers. LDK have now used DRP (Debt Recovery Plus) to send letters, having done some research, people were saying unless DRP have bought the Debt to just ignore it, DRP do say in the letter 'Our Client' so that indicates they haven't bought the debt so should I continue to ignore this?

    Much Appreciated
    Thanks

DRP don't buy debts, if they did it would bankrupt them because everyone is told to IGNORE DRP.

Just ignore these annoying little letters, they will keep coming for a while with stupid threats but in reality, only LDK can go further and take you to court.

So IGNORE, if you get court papers come back here
NEVER TALK TO DRP OR ADMIT WHO WAS DRIVING

    couple of things

please start a new thread relating to "your" incident

the newbies thread , please read https://forums.moneysavingexpert.com/discussion/4816822

in your case contact the landowner , or the site you visited and show them the threatening letters , remind them (if appropriate) that future callouts will incur a £100 parking surcharge that you will add to your invoices

when reading the newbies thread , notice shoiuld be made of the timing of letters to you ,

  • I'm new to the site and appreciate you posting the link for the newbies thread because I hadn't a clue how to find it, I also mentioned in my message that I didn't know how to make a new thread, when your new to a site, "sticky newbie thread" was like reading a different language haha, and I only operate of my iPhone so it's not straight forward...

Thanks for the 2 replies though, I think after reading the newbies thread, the best thing to do is not contact them, ignore them but keep letters for harrasment, thanks again.

Yes you can safely ignore debt collectors but IF you get a solicitor's letter or Court Claim form, come back and start a new thread (not on a phone, honestly, you can't access the wealth of info on this parking forum properly on a phone).

BTW my signature under every post I make tells you where to click to see the NEWBIES thread. Don't wait for links...!

Thanks again for all your comments.

I took Redx's advice and complained to LIDL CEO, and appealed to LDK.

LDK replied back with a letter informing me my appeal was REJECTED. And LIDL's have replied by email explaning "the most effiect way to appeal your parking charge is to do so with the Car Park Management company direct". And requesting my permision to pass my details onto this company for appeal which I dont believe will do any good because ive already had my appeal rejected by LDK?

Im a bit stuck with what to do next and would appreciate any more advice. LDK are demanding a payement of £45 within 14 days after which it will increase to £90. They are also saying "Failure to comply will result in your details being passed onto Debt Collection Agents. We may also start court proceedings without further warning and extra cost will be incurred."

    Thanks, Tina
