    Any PPC who takes a double dipper to court needs their bumps read imo. Even if you have no proof that two visits are made, a judge is hardly likely to rule against you when there is so much evidence that the technology is not always uip to stuff.


    I read somewhere that it is only 90% accurate. Not good enough surely for a judge to apply balance of probabilities in favour of a PPC. nnas

    Just to say to newbies reading this, they were unlucky with the Judges and both forums assist people to still win most cases, if court claims are issued.

    I've sent a strongly worded email to the CEO's office. I have to admit I am tempted to pay the ticket and do as suggested above; my parents are both additional drivers on my car so it would be tempting to nip in a couple of times with different drivers and see what happens.

    I have just now received a response from the Tesco CEO's office. Apparently they have reviewed the CCTV footage and found that my car didn't leave.

    Obviously that is nonsense - but the driver did violate the terms of parking nonetheless.

    I'm kind of minded to pay though, I have to say. I just get the feeling the fine will end up going all the way to court before they pull out (that seems to be the way these things go), and I'm not sure I want the hassle of having to prepare for it all in that way.

    What exactly do Tesco say? Surely they don't mention checking 'CCTV' which would not show a car's movements. ANPR surely?

    Thank you for your patience while I look into this further.


    I've spoken with the Store Manager, Lewis, who in turn has gotten in touch with the Claims Manager at Excel Parking. The Claims Manager has reviewed the CCTV footage of the day in question and can only see your car enter and leave the car park once I'm sorry to say. I realise this may be disappointing however due to this the ban won't be overturned.


    Lewis has advised the parking company aren't very lenient with their fines with even some of our own staff falling foul to a parking fine in the past, which we also have been unable to get overturned. Sadly, as we don't have a direct contract with the company, we don't have a say in the fines that are issued.


    I truly am sorry about this, I wish there was something we could do.

    Their claim is total BS - for starters I haven't told them which day the alleged breach took place, only my number plate, so unless they have access to the ANPR logs (which they are claiming they wouldn't) how would they know?

    Also, who are Excel Parking??

    My worry is that I am on a hiding to nothing as I did breach the terms.

    Excel Parking is the sister company to VCS Parking and owned by the same people , but 2 different entities , just like PC World and Currys are separate trading businesses but owned by the Dixons Group

    they often get mixed up in these cases, which can work in your favour

    no CCTV would have been used , it would be ANPR Cameras which are notoriously unreliable (see parking pranksters blogs about this topic)

    reading the letter above , it seems they may not own the land but they should certainly know who does , because it is the landholder or managing agent for that landholder who has the power to cancel pcn,s , not necessarily the business who may rent the retail outlet

    bear in mind that VCS do not know who was driving on the day , so unless you have inadvertently admitted it then although it may be true that one driver may have breached the terms , it could have been 2 different drivers who did NOT breach the terms

    VCS do not adhere to POFA2012, they have no idea who was driving unless some fool tells them (ie:- you) and so they have to prove their case so a judge is more sure than not , if you havent named the driver , plead the 5th !! lol

    Asking any organisation to examine CCTV footage is a total waste of time. If the period you want reviewing is (say) a 5 hour period, searching for a (say) black Corsa, even with a VRN provided, it would take an individual staff member of the organisation at least 5 hours to go through it all, examining very grainy pictures, stopping, rewinding, slowmo's, zooming. Let's be realistic here - it just ain't going to happen.

    You only need to see the poor quality of shop CCTV footage shown on programmes like Crime Watch and for crimes like murder (not a parking overstay!) to surely realise that there's absolutely no prospect of getting any modicum of irrefutable evidence for a parking incident, or of any organisation giving a request for CCTV footage any serious attention whatsoever.

    I didn't ask them to go through the CCTV, I just asked them to get the charge cancelled. That was their response. I feel really rather like I've been shrugged off.
