can i make a claim for criminal defence cost in the small claims court?

  • Lawyers and Solicitors fought these cuts all the way but to no avail. British justice has been watered down because of them I am afraid.

    Op I think your problem lies in the fact that you (quite rightly imo) chose to employ an expensive lawyer and so the costs did not cover those fees. I think you need to go back to them and ask about the likelihood of a claim in court suceeding, it will obviously incur more costs but only they know the nuances of your case and so they can give the best advice.

    Its not abstract, the actions of politicians have had a very real impact on people's lives, its actually happening, as evidenced by this post...

    Maybe some people will write to their MPs, maybe they'll look closer at the policies of the parties at the next election, maybe they'll sign a petition. What other advice is there to give somebody whose problem is that the law has changed and made them worse off?

    Also, my posting does not prevent anybody else from posting.

    And has anyone actually been able to provide the OP with accurate advice, other than telling him to seek it from a professional? The only posts I have seen (bar one) in respect of the small claims process have been inaccurate.

    Yes, I don't know if there is a 'legal board' on here as such? The Marriages and family board will elicit opinions (enough said!!) but possibly not much legal expertise.

    Where he was advised to create his own thread, but decided to do so on this board rather than in Consumer Rights where members who have an understanding of the small claims process usually respond.

    I seems that you will have difficulty in proving that your ex was responsible for your wrongful or malicious prosecution as it was the police that decided to refer your case to CPS and it is therefore the police that you should pursue if you want recompense. She may have told the police a pack of lies but the police, who are trained in how to spot a liar, believed her and they decided to initiate the prosecution.
