Was I Mis-sold

Hi Folks,


I bought a voucher from Groupon for a holiday for 2 to Iceland in a city centre hotel with four excursions included. I then had to phone a holiday company to book the holiday.


I phoned the holiday company and they booked the holiday with only 5kg of luggage. Then just as we were saying goodbye the lady said actually I have a slightly dearer holiday with 10kg of luggage for only £78. This one is 12-15 minutes away. As we obviously need warm clothes in Iceland I accepted.


She told me that once booked the holiday was non cancellable but I was happy with how it was described over the phone I booked and paid the additional £78.


An hour later she phoned me back to ensure that I knew that we were responsible for getting ourselves to the meeting point for the excursions. I said that was fine as we had only a 12-15 minutes walk. She went quiet and then said you have a 12-15 minute drive to Reykjavik.


I have checked with the hotel and to get to the meeting point we will have either a 10-15 minute walk plus £3 bus fare each way per person if the buses are running as we need to be there early. If not, it is a £35 taxi ride each way, i.e. £280 for four excursions.


My question is was I misled and mis-sold this holiday? I feel so annoyed that I wish to cancel the holiday but I agreed that it was non-cancellable. Do I have any legal options?


Any advice would be greatly appreciated.

    How much was extra luggage on the original holiday,if it was less than £39 each you should have went with that option,as for miss sold,did you not google the other hotel before you confirmed the booking,it might be a dump.
    If the buses are running,and you can use google to find out you will no problembs,enjoy your holiday

    Maybe but unless you have a recording of the call, you're unlikely to be able to do much about it.
    Change is inevitable, except from a vending machine.

    The difficulty will be that you were given factual information but made an assumption over what that meant...personally I would not have assumed the 12-15 minutes was walking time and if in doubt would have asked the question to confirm
    I like to research hotels etc before committing so would have been unlikely to book on the initial call...it is acceptable to say that you will have a look and call back
    If you were happy with the initial choice of hotel (which I assume you researched) were you not able to pay for additional baggage?

    When we were in Iceland, most, if not all, of the excursions left from a central point in Reykjavik, however the tour company ran small buses to pick up people from most hotels, take them to the main departure point and drop them off at their hotel afterwards which was included in the price. Which operator are your excursions with?

    Sorry I haven't responded earlier. I have not been too well over Christmas. Thank you very much for your replies. Let the buyer beware! I should be old enough to have known better. I just seem to have remembered something from contract law 40 years ago which said "what would a normal person have thought" but thinking about it I guess that only applies to a written contract anyway.


    There are pluses to being so far out of Reykjavik in that we will see the Norther Lights better if they come out to play while we are there. I guess I'll just have to bite the bullet on any travel costs and minimise them where possible.
