    I'm surprised you don't get continuous employment with the civil service.

    So am I. That's worth checking again with your HR department.

    I already checked...it was the first point I raised as I was pretty shocked...For the purposes of redundancy/pension my employment is continuous but apparently not for sick pay...


    I just filled in the HB application, it says I am entitled to £0, though I ticked that I am working (there was no option for historic sick leave...), so that isn't surprising. It did say my answers suggest I may be entitled to tax credits...


    How would I go about a backdated claim? The only thing I can do is tick that I am off sick when I'm not...it then asks if I am being paid (including SSP). Would I then put in the SSP rate in the salary section?


    EDIT: Have put in the SSP amount and it is saying I am entitled to full HB...also Haringey back date for 6 months so less of a nightmare if it does take time to apply...

    As you are in receipt of DLA it will increase the amount paid on Income Support. Put in a claim. The worst they can do is say you don't have an entitlement.

    Have put in claim for HB. Need payslips to evidence my pay...here in is where the issue begins as they have ballsed up my payslip and essentially paid my normal salary and then applied a credit rather than SSP...

    I cant offer help re benefits but as an ex civil servant - this sick pay situation surprises me. Have you spoken to your union rep ? HR dont always get the law correct. Also was your sick linked to your disability ? Were you getting any treatments for disability whilst off ? Did you just transfer depts on promotion etc ?

    Ditto. That sounds a bit suss to me. If redundancy entitlement is transferred why not entitlement to sick leave? I'll bet there are an awful lot of civil servants out there who don't realise that if they change jobs within the Civil Service they greatly reduce their entitlement to sick leave.

    You have seen chapter and verse in your terms and conditions re continuous service and sick leave?

    If the employer is correct and there has been an overpayment, it seems to me that as it was HR's error that has put you into financial difficulties, you could make a case for the repayment to be made over 12 months rather than three?

    Sadly I am not part of a union. Could I sign up now and ask for advice?

    I moved department on promotion via an "other government department transfer" so that my previous 3 years service would be carried over for pension/redundancy.

    It does seem dodgy to me...it is set out in my contract...though it just says period of service rather than period of service with x department...

    It wasn't disability related, it was essentially mental health related...

    They wanted to take it all in December, so getting them to spread it over 3 months was a struggle...

    I'd be surprised if the union would help with a problem which occurred before you became a member. You could try speaking to local reps though.
