  • hi forum, just a quick update, BW legal have sent me a letter of discontinuance, so I have it in writing, worth noting that the amount allegedly owed on this letter is more than the amount on the letter of claim, not sure how that works, they don't seem to get their numbers to match ever.

    Next step is trying for costs, and i ll try and post copies of my evidence, index, and how i set it out, (my defence, WS and skeleton are already posted in my thread)

    i may have to use dropbox, but not entirely sure how it works so any suggestions welcome, if the work i ve done to date can help someone else then great stuff.

    don't panic (i did) its stressful if you let it be, listen to good advice from the regular posters, and remember, a little fish with a big heart can beat a shark, just keep swimming.

    Well said, and well done for getting the discontinuance. Dropbox is really easy and self explanatory... Just register, login, upload... Then click on 'share' to generate a link you can post on here.

    Vert well done. I hope you will be invoicing them for your time, even perhaps issue an LBC. You will probably not get a penny, but it will cause rxtra work for them, and will cost them money, for which they will, hopefully, bill the PPC.

    Also consider a very robust complaint to the S.R.A.
    You never know how far you can go until you go too far.

    Have there been many other cases discontinued by Excel/BW Legal? If so, is there a type of case that they discontinue or any common theme at play?

    I was under the impression that they always go to court! Good to see they can be shaken off before it.

    Not sure there is a common theme. They do discontinue some, but mostly go to a hearing.

    i was ready for court, and was quite close to it, I think you have to work towards that end game, prepare for court, expect to go there, and then anything else is bonus. I did as much research as I could, gathered as much evidence as I could, and asked lots of daft questions that were nicely answered by the folks on here, in an attempt to win in court not for a discontinuance.
