We are going for a Letter of Administration which inheritance form do we need to fill in, we have downloaded the PA1 form but are unsure of which tax form to download, to send with the PA1

That depend on the size of the estate. if the estate is larger than the nil rate band, then you need IHT 400, if not IHT 205. Even below the nil rate band there are some conditions where you need to use IHT 400, but if you start off using 205 it will tel you if you need to switch to 400.

Thanks for the quick reply, but I am unsure what you mean by the nil rate band.

The nil rate band is the amount below which no IHT is payable. In the case of your FIL it is £325,000 as you MIL is still alive.

Even if it is above that IHT should not be an issue as none is payable where the estate passes to the surviving spouse.

The other issue you need to be aware of is the distribution of his estate. As he had no will the rules of intestacy apply so if his estate is valued above £250,000 then not all of goes to his wife.
