    I would not counter-claim in this case. Just send that defence and get ready for the roller-coaster ride until you win!

    You might then want to make a claim against the parking firm and the landowner jointly, using your court win as evidence - and the very fact of also sending an LBCCC to the landowner is more likely to get a payment made to you in the end IMHO. But I would say that's revenge, a dish best served cold (and by then you will be able to see what sort of successes we are having with the DPA breach claims, as it is a new tactic).

  • I intend to get a written statement from someone I know who used to work in a shop served by the car park. Does this mean that I should answer 2 to Question D3 about the number of witnesses?

    If I don't get the statement might I be asked about the absence of the witness?

    Yes, two WS but if you get a written statement and that person doesn't show up with you to a hearing, the other side can object because they can't question that witness. Don't let it stop you though, chuck the kitchen sink at it, if relevant.

  • Do I send a copy of the DQ (N180) to the court for them to pass on to the claimant or do I send it directly to Excel's solicitors?

    The landowner frustratingly refuses to respond to communication, it would be good to know if they have thrown Excel off the site, as it is now managed by a different company (and is now free instead of Pay & display)
