Parking Eye Macclesfield Hospital

Hi all

Apologies if this is already answered in the newbie FAQs but that thread goes on forever and I couldn't find anything that related to my specific circumstances.

Any advice or pointers would be very much appreciated.

One evening at the end of November, my mrs took very ill. Long story short, we are currently going through IVF and I was seriously worried about her. I called an ambulance and paramedics turned up, decided she may be experiencing an ectopic pregnancy and rushed her to hospital in the ambulance just before 10pm.

Naturally I followed in my car, and hoofed it over to A&E as quickly as I could, and parked as close as I could get. The car park at that time of night was pretty much empty.

Anyway, imagine my horror when I received a fine yesterday from PE for parking illegally there!

So my questions for you all are thus:

1. Is it unreasonable not to be concerned with parking regulations under the circumstances in an almost empty car park?

2. Is it unreasonable to assume that parking charges would not be applicable in the middle of the night in A&E?

3. Parking Eye claimed I entered the car park at 9:54pm and left at 1:54 am. This is not strictly true as I left and came back TWICE to bring things for my mrs which she needed to stay in for a couple of nights.

4. I have been to look at the signs today, and the major signs are NOT illuminated, so you couldn't expect someone in those circumstances to even spot them! Between my parking space and A&E there is only one sign which is attached to a street lamp.

    Read up the newbies faq thread to learn what you have got involved with and how to deal with it.


    PE aren't interested in any mitigation - you need to go through the formula advised to get a POPLA code (all explained in that thread)


    And complain to the hospital along with progressing your appeal!

    If you only received this yesterday regarding an event in November, then am I right in guessing that the PCN is one with no mention of the POFA/'29 days for keeper liability' and a blank space at the bottom? An example of that type of PE PCN (the best type!) is shown in post #3 of the NEWBIES FAQS thread, which is the sticky advice thread you need to read anyway because your first step is to complain to PALS (Google it) which is what the advice tells you.

    Look at the non-POFA example of a ParkingEye PCN and tell us if that's exactly like yours?

    If so, please edit your first post above to remove any mention of who parked.

    You also said the car had actually gone in and out of the Hospital 3 times that evening, therefore PE had no grounds to obtain your data and allege that three visits were one.

    Have you complained to PALS (Google it) and/or the estate management people at the hospital?

  • The upshot, by the way is this.

    East Cheshire NHS Trust Board commissioned PE despite DoH guidance to the contrary. They fudged the issue, saying that the contract was going through at the time of the release of the guidance.

    The CEO has tried to get PE instilled at the satellite hospitals, Knutsford and Congleton. Local MP's have stopped this due to the complaints about PE.

    Macc are stuck with PE for, I believe 3 years, as there is a penalty clause for early cancellation of the contract. (In the region of 170k pro rata.

    The trust have asked PE to be lass aggressive. PE have refused (see page 9 http://www.eastcheshire.nhs.uk/Downloads/June%202016%20Trust%20Board%20Agenda%20and%20Papers.pdf)

    Meanwhile the misery continues.
