Non-fault accident procedure?

I'm new to this site and I'm not very good at talking to companies on the phone.
Recently I was involved in a non-fault car accident. I'm looking to see if there is anyone out there who has been through a similar process, if I am being totally messed about with and if there is anything I can do. Basically I feel like i'm completely alone throughout this whole process, I have done nothing wrong and I am having to deal with a lot of companies regarding the crash. My car (which I had on finance) was written off, the insurance company have settled but at a figure which means i'll be out of pocket (stupidly didnt have gap insurance)
I was off work for a week with my injuries, I didn't get everything back from my car, I also had a full tank of petrol thats completely gone too :wall:I was given a hire car by my insurance company, and I was offered a replacement vehicle scheme by my insurance too which I agreed to. This was through Arnold Clark, I was sent an option of 2 cars the same as the one I had (except with way more mileage on them) but when I agreed to buy one of them, I was told because the price difference, I would have to pay the difference. The salesman I was dealing with told me it would be more beneficial to start a whole new finance agreement on the new car, that my old car would be settled through my insurance claim and any money still due would be paid by their company and I would receive a cheque for the difference and it would be added to the end of the finance agreement on the new car so I wasn't out of pocket at this time of year.
The car had a dent in the side so I was told this would be fixed before I got it, I don't live near the garage and was told they would have it sent to my local branch to collect. They called me to arrange all this on the 10th of December and said I would have the car by the 16th of december.
The salesman called me on 15th of December to say there would be a delay on the car and asked to change the collection date of the 17th which wasnt suitable for me, I asked for the 19th but that wasnt suitable for the salesman so we agreed I would pick up the car locally on the 20th (today)
Had a phone call today to say the salesman I was dealing with was unwell and my account had been assigned to someone else, and was told the car had only just got back from the workshop and wasnt ready.
While all this was happening, I had been receiving letters and phonecalls from the hire company to say the contract was finishing on 19th, I had arranged for the car to be collected between 8-4pm from my home address, my partner had to cancel an appointment for them to collect the car, but they didn't show up, blaming christmas traffic and have asked I stay in tomorrow so they can get the car.
Throughout this whole process, I am going to be out of pocket, I am without a car, I am still stuffering from my injuries sustaned in a crash what was in no way my fault while having to concentrate on the busiest time of year at work (I work in a pharmacy) my life has completely been put on hold and I feel at every point I have had obstacles to overcome with no help or support from any company dealing with my claim. Has anyone else had this many problems regarding something like this? Surely I shouldnt be getting messed about like this from the car company? The insurance company should be doing more to reclaim costs from everything? I shouldnt have to be chasing people for answers either. The finance company is also sending me daily letters regarding an ourstanding balance, less rebate of charges and settlement figure and I have abolsutely no idea what the letters mean or if I have to do anything about them. Something just doesnt feel right about the whole process! I don't know what my rights are and i'm abolsutely terrified to question the process in any way incase I come across as stupid because I dont know what i'm doing. I'm a hard working individual just wanting all this to blow over without any issues or confrontation, I like to think i'm a good person who always tries to do the right thing and I am getting nowhere, this is been an awful process!
Massive apologies for the long winded post, this is the first time I have been able to write everything down to get it all out, and i'm sure people go through this every day. Yes I am thankful that I was able to walk away from the accident, it could have been so much worse, however the stress and confusion it has caused for me at the end of my first full year of driving has been horrible.
Does all this sound like the norm? Or are they taking the mickey?

    First thing is first: If you don't know and are not sure then ask. It doesn't matter that you look a fool for a few minutes with people you don't know and will never see again.
    In your industry its imperative you ask questions as it could cost someone's life if you get it wrong. While in your current problem it could cost you money and your credit worthiness.

    Phone the finance company and let them know what is going on. They don't know yet you are planning on settling the finance through a new finance agreement on another car.

    Also on that point, you may find you are charged interest on that loan to settle the old finance so it may be cheaper for you to settle it quicker if you can.

    While it sucks that you have been left with the shirty end of the stick, though it is through no fault of your own, you are the only one looking out for you. So to get the dbest result you will have to get involved.

    If you think that you have any quantifiable uninsured losses you can make a claim for them from the 3rd parties (the person that hit you) insurer but you will have to be able to prove them. Or you can use your legal protect if you have any.

    There is always hassle for both parties (the innocent as well as the driver to blame) when you are involved in a claim.

    You need to take up these issues with the people involved


    1) The new car not being ready on time is nothing to do with your insurer - take it up with the dealer if you feel you have grounds for complaint and compensation


    2) Your injuries and lost earnings are again nothing to do with your insurer. If you have legal cover with your policy then make use of it to sort all your uninsured losses for you


    If you don't have legal cover then consider using an injury compensation legal company/accident management company to take your case
