Well I emailed the store and have had a reply but just to address some of the critisisms of me that have been made a little background.... I did not know about the 7/14 day exchange/refund policy but my main interest in chasing this up is NOT to get the store assistant in trouble but because I am interested in purchasing a far larger and more expensive item that they have on offer (reduced in price) and what happened over this train set raised my concerns so I was not trying to find out for no reason. Anyway I received an email back from the store that explained that their member of staff would have been referring to their own refund/exchange policy and that my statutory rights were intact and would be honoured... I now feel far more confident about making the further purchase although of course because of the lack of clarity they nearly lost a sale.

This is interesting because in reply I specifically stated that faulty goods were covered by law and not their policy and the 7 day limit was reiterated. I have now written to the store to see what their response is. However having read these replies I rather feel they are not training their staff correctly because the member of staff seemed genuine in believing what she said. So I hope this is just a mixup beteen the law and their own 7/14 day exchange policy which I have to say I was not aware existed.

The retailer mentioned a particular scenario which was correct and then you told them they were wrong because not only did you use the wrong legislation but you misunderstood what you were being told.
With all the publicity and availability of information why is it that when someone says 'I know my rights' they still usually don't.
However I hope the train set is exactly what your son wants and he gets many hours of pleasure from it.IITYYHTBMAD0
