Gold in incorrect packaging

Hi

Ordered a few bits of gold, based on the photos displayed on the webiste and my own research.

Chose items for several reasons, one of them being their aesthetic appearance.

Company sent me a couple in the packaging I saw but the others in diffrent packaging. To me this is 100% unacetable. I want them all the same. Uniform. As I chose. But they told me, "the gold company sells them in different types of packaging" as if that was that.

No way. I want them to exchange the ones I dont like for the ones I do.

What can I do? As it's gold, these are items that "fluctuate in price" so normal distance selling rules do not apply. Also, I made the order at the start of Nov 2016, over a month ago. However, it was not dispatched until much later as they lied about it being in stock too.

What can I do?

    It's not the packaging the gold arrived in, postal packaging, it's the packaging the gold is housed in, the assay card etc.

    It is of utmost importance to me - your arguement, "gold is gold" isn't justfied as the company themseleves sell gold at all different prices... why? if gold is all the same? All the manufacturers are well know and trsutworthy. The reason for price differences is to do with appeal. I was willing to spend more to get what I considered to be a beautiful overall product. Instead I got something that I don't like. So I want it exchanged.

    It's very simple.

    If they were delivered less than 14 days ago you have the right to return for a full refund (assuming they were bought from a U.K. Company) you have no rights to have the packaging the same, it's what's in the packaging that matters.

    This may or may not be correct depending on exactly what it was that was purchased.
    If it was something such as gold jewellery that sells with a fixed price then yes, they should be able to return it (providing that it was from a UK company).


    However, if it was investment type gold (such as bars or coins) then these can't be returned under the 14 cancellation legislation as they fall into the exempted category of goods whose price fluctuates.

    Is the packaging something that is regarded as significant within the market generally? So would it affect the value of the items, all else being equal? Or is it really just to you that this is an important consideration? (The reason I ask is that I suspect if it is the former you will have more rights than if it is the latter.)

    "UBS produce both styles of bars. Both are X Gram UBS gold bars as advertised."

    ...was her response. So I have 3 of one (that I wanted) and 7 of the others (that I didn't)

    (but having said that, gold of the same weight is available in different form and packaging and is much cheaper so.... obviously the packaging DOES affect the appeal to customers and therefore the price.

    My interpretation is that you were sent gold bars in a style that was different from that on the website but that there is no difference in the market price between the two styles.

    If that is the case then my view is that you will be unlikely to be able to win any remedy from the seller, in respect of the difference in style, if you take the matter to court (unless you made the style of the bar a condition of the sale).

    My suggestion it to try and see if the seller is willing to swap the bars (possible at a later date) for the style you want. Perhaps offer to pay a smallish fee if necessary.

    I also don't think you will be able to win any remedy for the late delivery of the items (as you suffered no financial loss).

    You are probably right. Maybe I will ask another bullion dealer if they will swap them for a small exchange fee.

    So stupid of this company not to do it for me. A lost customer on quite a large purchase. Such a bizarre attitude!

    If buying more in future try and make the style a condition of the sale. (I suspect only some dealers will agree to this.)

    Looks like you pay a fairly hefty premium for these small bullion bars over gold coins.
