I had a Morgan Stanley card many years ago and unfortunately I believe all my statements etc are buried in my husbands warehouse in archive files. I had a letter from high street claims so I thought if I have no account number etc maybe they can find out for me so filled in the authority letter, they have replied and it turns out Morgan Stanley is now Barclays and an account number I am aware off because I have just finished paying their debt off and PPI on it - high street claims are asking me to complete some more authority forms and a questionnaire so they can claim back the PPI for me at 30% plus VAT if successful - my question is can I just ignore them and go after the PPI myself - or am I under obligation/contract to carry on with them. I am doing my own with PPI claim with Sainsburys at moment.

BTW Sent letter to Sainsburys asking for copy of agreement etc with £1 postal order using Martins standard template they returned the PO and said they have 40 days in which to respond and not the 12 days as per template. I also found some old statements after sent letter which clearly shows I was getting charged PPI do I still have to wait for them to send copy of credit agreement or go ahead and put in a claim for PPi - any thoughts please?

    Sadly this is one of the myths that CMCs propagate - the idea they can magic up old records whereas they just have the same info as you.

    I would imagine if you have signed off a letter of authority that allowed them to submit a DSAR or similar they have the right to complain on your behalf just need a letter for Barclays - if you refuse to sign it they will probably bill you for admin costs (they'll come up with some nicely inflated costs) and if you don't get them to put in writing you have cancelled they'll send you a bill for their cut anyway.

    I guess it depends how much of a potential refund you might have if you win your complaint vs what they charge you to cancel - once stuck with a CMC it might well work out cheaper to stay with them on the no win no fee basis

  • Very true words yes I can see your point - lot of these CMC now advertise that they will check on your behalf if you have PPI and you are under no obligation to carry on once they have found out for you but once you sign Letter of Authority does this amount to signing an agreement with them?- I don't think I signed anything with terms and conditions on etc just a letter or authority for them to act - need to dig out the original letter.

    That's permission for them to act on your behalf, so a contract has already been formed.

    Probably more cost effective to proceed with them now, since you will otherwise pay cancellation fees.

    Yes, a letter of authority means they can act on your behalf.
