Consumer Rights - John Lewis PC

Hello
I purchased a PC from John Lewis online based on the specification advertised and price. I wanted it for Xmas. However when I received the PC it is a much lower spec than was advertised eg processor much slower, smaller harddrive, non touch screen, when i ordered touchscreen. They confirmed over the phone that the PC sent was described wrongly on their website and they haven't got one in stock the spec I ordered. (They have a very similar spec to what I ordered but it is out of stock right now and £200 more) They have offered me a full refund which is not what I want. I just want the spec of PC that I ordered, and I particularly wanted a PC from John Lewis as they offer 3 year warrantys and good aftercare. Please tell me what my rights are?

Your rights are to return the PC you were sent for a full refund. You should also not be left out of pocket for any delivery charges.
Unfortunately you can't force them to sell you the PC you ordered. If it is out of stock they don't have one to send you.0 -

Legally you are entitled, very broadly, to expect be put into the position you would have been had JL not breached the contract, in other words into the position you would have been had JL supplied the pc specified.
So if a refund is not sufficient to replicate the contract (as far as reasonably possible) elsewhere (because a similar pc is more expensive than the refund) then you are entitled to claim the shortfall.
In practice retailers tend to be very reluctant to agree more than a full refund. (Indeed I am sure many, probably most, shop workers genuinely believe a full refund is always a sufficient remedy.)
So it is possible you may need to sue JL if you are unwilling to accept the full refund.0
