Evans Halshaw Not refunding "Move me closer" deposit

Just a warning about Evans Halshaws move me closer scheme. Basically the scheme works by offering to move a car to your local branch FREE for you to view. You need to pay a £200 fee but If you decide the car isn't for you your money is REFUNDABLE - so they say,
I ordered a car to be moved to my branch online and paid £200. After the sales person emailed me a finance quote I realised that I couldn't afford the car as the repayments were higher than I'd thought and the interest charged on the HP was ridiculous and I didn't want PCP, so I replied saying I wouldn't be viewing the car. I never got a reply so after a week I contacted them for a refund and was told because I didn't view the car I wasn't entitled to my money back.
If I had paid a non refundable deposit on the car I'd expect not to get a refund, But considering the scheme is advertised as FREE and REFUNDABLE I feel this is unfair.
So basically the warning is if you order a car to be moved and then change your mind for whatever reason, at least go and see the car then make up some excuse- although I have a feeling they will try force the car onto you.
Just a side note I bought two cars in two years from this branch and would think they might value me as a customer but obviously not, wont spend another penny in Evans Halshaw.

Of course they will! You would be considered a positive lead (or whatever term they use in sales!). Someone who is going there with a view to buy. That's why they are more than happy to refund the cost, because they'll do a hard sell on you and convert a fair number of times.
Doing what you did was a pure waste of time! They moved a car for you (which costs petrol money, wages, other overheads) and they had 0% chance of selling it to you because you didn't show up! Time waster.
Though, why would a car dealership ask for a refundable deposit in the first place if they were going to refund a no-show? I don't understand why they would..... either you show up or your don't, so if a refund is due in both scenarios then the whole taking a deposit thing is completely pointless!
Would have been handy to firstly find out WHY they took a deposit and what conditions would cause forfeiting of the deposit.0 -

I'd guess that's your answer. You are in breach of contract.0 -

10. Where a Customer is unable to attend an Appointment, they must notify Evans Halshaw by telephone or email to Evans Halshaw as detailed on the appointment confirmation email and make a Revised Appointment.
11. Where a Customer does not attend an Appointment or a Revised Appointment, the Reservation Fee is forfeit and will not be refunded.
Seems to me that maybe the finance isnt so bad after all and you should make that revised appointment before making a decision?0 -
WHY do people pay this? When we were looking for a secondhand car EH dealer near us said he had found just what we were looking for down in London and said he would arrange for it to be transfered if we paid the £200 so we said no thanks and were walking away when he said the car would be there for us the following week. When we went to look it was a dog, obviously badly treated, scratches inside and out, dirty and no manufacturers service history just a garage stamp in the book!
Needless to say we went elsewhere. Shame as this EH isn't bad, we bought our last car, an ex demo, from them.0 -
Why didn't you view the car, and then if you liked it, negotiate the finance? The rate you are initially offered is only their opening gambit, there's always bargaining to be done.No free lunch, and no free laptop0

There are so many threads on the motoring board about EH (none good) you could consider this a lucky escape that has only cost you £200 not the £k's you could have lost buying a lemon.0

On 23rd May 2018 I paid my deposit to have a 64 plate Mercedes ML250 moved from Stratstone Land Rover Cardiff to Evans Halshaw Kia Hull. The vehicle was on sale for in excess of £23000.
I received a receipt for my money which stated the vehicle reg. was CF62FBY ( NOT A 64 PLATE AS ADVERTISED). I immediately rang the help desk who tried to speak to the Cardiff showroom. No answer. The next morning I rang Kia Hull only to have to phone picked up and put down on me twice.
I then E mailed the Pendragon Enquiry Team - Still No Answer
I then E mailed the Evans Halshaw Enquiry Team - Still No Answer.
I sent the e mails to assist the company in that I didn't want to test drive a 62 plate vehicle.
I then filled in a form for the Evans Halshaw Customer Concern Portal and received an undertaking that they would ring me within 24 hours - they never rang.
In desperation on 7th June 2018, I sent a registered letter to the CEO of Pendragon - Mr FINN - Still No Answer.
Eventually the 'dealer principal' from Kia Hull rang but could not give an explanation.
The vehicle had not arrived in Hull and had miraculously disappeared from the website.
Still no refund. However Stratstone Cardiff did attempt to re-advertise the Mercedes again until I passed comment and again it miraculously was no longer advertised.
I was promised the refund last week and even gave my bank details.
Still no refund.
SO, IN SHORT - CHECK THE VEHICLE YOU PAY TO HAVE DELIVERED IS THE ONE YOU SEE AND WANT TO TEST DRIVE AND BE PREPARED TO BE WITHOUT YOUR DEPOSIT FOR A CONSIDERABLE TIME IF YOU DON'T BUY THE CAR.
I could go further but hopefully you get the gist of my tale.0 -

CF62FBY was first registered on the 14/11/2014 so actually it would have originally been on a 64 plate when it was first put on the road. Someone has obviously put a private plate on it.
So basically you made all that fuss just because the number plate had a 2 on it instead of a 4. I really don't see why you refused to test drive it because of that?0 -
You have completely missed the point. My gripe was towards the company and its 'couldn't care less attitude'. Not the fact the car was a misrepresentation (advertised as a 64 plate).
As for your comment relating to 'all that fuss'. Why are you getting involved. Do you work for this bunch of amateurs.0
