Sharedownership sale and missing NHBC cert

I wonder if anyone can advise.

I'm in the process of selling my share of a 5yr old SO apartment. The housing assoc have identified a buyer and we are moving towards a completion date.

I bought the home on the understanding that NHBC warranty was in place and my solicitor's report on the title at the time of purchase was that the cert would be transferred to me upon completion.

I recently rang NHBC only to be told that they couldn't find my cert but had them for the rest of the block.

Housing Assoc haven't been much help and I looked at my contract at the point of sale and its states they will use their best endeavors to procure the issue from the builders.... which leave me feeling that my solicitors at the time were not particularity diligent in advising me of any pitfalls.

The builders are of good repute and continue to develop the project, selling properties with NHBC cover. So I would be surprised if they hadn't sought registration with NHBC for my flat alone. Unfortunately, they haven't gotten back to me when I called to make an inquiry.

I'm now of course anxious that I may lose the sale.

I've left the issue with my solicitors who have now closed for the holiday season! So I'm left in limbo.

Can anyone advise if this is surmountable or share any experience.

    It's entirely down to whether the buyer wants to buy a flat that doesn't have the five remaining years of warranty that they thought it would.

    In the event that the warranty can't be found is it possible to get cover retrospectively?

    If developer was nhbc registered and only your flat is missing, chances are it's either your purchasing solicitor failing to request certificate at the time, or some mix-up with flat numbers etc. Either of which should be capable of being sorted.

    So if your current solicitor has beggared off for holidays a week early, I suggest just chilling until they're back, as nothing else is going to happen before then.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Going through my paper work I can see the property is covered by Zurich Insurance. Is this the same as the NHBC cover?

    Zurich offer an equivalent scheme, so that would be ok. Bit odd for the other flats to be nhbc though, you'd expect the whole development to be the same.
