Help...has further deposit to be paid

Hi guys

I'm looking for some help 17 days ago I booked a holiday online with first choice. Low deposit 75pp advertised all over the place. Unfortunately due to family issues I've had to now cancel and when I phoned they are asking for a further 425 to cancel  at the time of booking I paid my 225 deposit which I was happy to loose out on cos I obviously know how a deposit works. I cannot afford a further 425 and think it's ridiculous as I have not used any service or received any product, and 650 for 17 days is extortionate. The customer services staff are to be honest...rude. Can I refuse to pay or will I be liable. What action can they take if I refuse?? Many thanks

    From First Choice''s website.

    "TERMS & CONDITIONS
Please note, the remaining balance of your total deposit will be due 8 weeks after your booking has been made, or you will be required to pay the remainder of the total holiday cost, whichever date comes sooner depending on when you booked your holiday.
If you book using the low deposit scheme and then cancel your holiday, the remaining deposit balance will be due on cancellation. Deposits are not available on holidays departing within 12 weeks of departure date."

They can sue you for the money - that's the action they can take if you refuse.

You agreed the contract and the terms and conditions, so you must abide by them as posted kindly above.

The customer services aren't rude, they just aren't telling you what you want to hear. You owe them the remainder of the deposit, it is clear as day in the terms and conditions that you would have had to state you read and agreed to in order to book.

Pay the money. You owe it.

yes you owe them the remainder of the full deposits if you cancel, and you'll have to pay it, its all there in the T&Cs.

Can you move your low deposit onto another trip with First Choice, if another set of dates etc would suit you, and if First Choice would let you?

Yes you have to pay it. You agreed to it when you booked, and it quite clearly tells you that you will be required to pay the remainder of the low deposit if you cancel. You obviously don't know how low deposits work.

What has 17 days got to do with it? A deposit is a depost.

In fairness, we have no way of knowing whether or not the staff were rude. What we do know is that the staff were giving accurate information: the OP entered into a contract, under the terms of which s/he is obliged to pay the full amount of the deposit.

I am surprised no-one has asked whether any travel insurance was in place.

You have to pay it but you can claim it back on your travel insurance if it's for a reason for which you are covered.
