In this situation I would assume that the legal pack is correct and the property description was wrong, I would imagine that if the deal was completed on the basis of the legal pack and the garage isn't included in that then you don't own the garage. You obviously need to get a legal opinion on this, but I would also be looking at finding out who owns the garage and how much they would want to sell it. Not knowing how much you paid for the house and how much the garage is likely to be worth it may end up being cheaper for you to just buy it off the owner than go through all the legal mess that would be involved in going through solicitors and possibly the courts, even if you feel that the seller has tricked you / the auction house.0

Looks as though I'm on a losing battle. As many of you have said it is ultimately my fault for not reading the legal pack/not seeing the property. Bought the place for 300. With all legal costs and renovating I'll still make a 60k from a 1 month project. Probably 20-30k more if I had the garage - due to it being behind my house and on a gated private access. So may be worth fighting for.
Definitely I should consider spending that on the garage than going through legal route.
As for the auctioneers blocking vendor selling garage...I would think both parties would have agreed what is part of the package which the included the garage. Then vendor thought to change its mind and changed on the legal docs prior to the auction date.0 -
