    yeah I understand it goes to month by month but if he hasn't paid soon that's 2 months rent he has missed - i read this is when i can start to move to legally get him out.

    At the end of the day i know i'm going to lose some money over this and tenants seem to have all the power. I can't even take it as a lesson learned as we have done everything we can (bond/references etc.)

    I'm just thinking of ways to make him pay.... :)

    I think the lesson you can learn from this is to take it less personally.
  • Yeah i fully intend to do everything possible (legally). He's a professional guy who contracts so does rely on his reputation and having a CCJ etc would ruin his chances of new jobs in specific sectors.

    You can serve s8g10 when only 1p underpaid for only 1 day then proceed to court 14 days later. However that ground is discretionary so many landlords only go to court after s8g8, 10 & 11 when at least 2 months rent is unpaid.

    You can also start a small-claims case TODAY which will get him a CCJ faster: I'd do so & gently point out the risks of getting CCJ. You might get paid!

    He wouldn't get a CCJ if he pays it off within 28 days.

    Have you told them 'to do something', they're your agent, in essence they are you.

    he had a 12 month contract which was coming up for renewal and has just stopped replying. Agency is dealing with all paperwork but have sent the s8.

    If he doesn't pay and we take money from the bond - can I still sue him for something. I'm not too fussed about the money (will even pay more to go to court) would just like to show that you can't just do this kind of thing!

    In 26 years of being a landlord with multiple properties (currently we own 8 investment properties) I have only issued legal proceedings against one tenant.

    Believe me it just doesn't get better when you watch the judge tear them a new *rse, when they continue with the pathetic drivel that they think passes as a plausible excuse for not paying the rent. For example when my ex tenant said 'I'm in the process of buying my own flat, and I had to pay a deposit to my solicitor, so I couldn't pay the rent for a couple of months'.
