    Ok,

Lots of half stories and assumptions here.

They are correct in that they do not have to supply a signed agreement.

But surely there must of been court papers ?

As said above BW Legal are not bailiffs, just debt collectors, big difference.

Can you please tell us the whole story, condensed if necessary, so we can get a grip on what has happened.

If a country court judgement has already been issued against you, for a debt that is not yours, then you can only fight this one way now, and thats by applying for a set aside motion at the county court.

There is a cost of £255.00 for this, but remission is available for low earners.

You need to look online, find the court forms, in particular court form N244.

Fill it in, also apply for remission of the fee, send both to the court.

Post on Legal Beagles using the link in the post above, and tell them whats happened, they will be able to advise how best to deal with Lowell going forward.

So if its gone to CCJ, I assume a judgement by default, as you never replied to them? If you say they provided a reconstituted copy of the contract (which is perfectly legal) but it has your address on, then if its not your debt then are you saying its a fraud case?
Advice has been given above, but just be aware that as its a CCJ it is enforceable, so even if you apply for set aside, or go another route, just remember to not ignore all letters because you have applied to the court.
  • Lets hope the OP comes back to let us know what is happening.
