Mobile hasn't worked - Virgin has never resolved it

Brief story - ordered a couple of new Mobiles from Virgin around June, I think. After around a month, one of them had a dud battery that just died one day. After numerous calls about them sending a new battery, a new one never arrived.

I was told they were waiting for a restock of spares and as soon as one arrived it'd be sent out.

It's just been sat in a drawer and forgotten about since.

I've been meaning to chase it up, but life happens and a lot of has happened between then and now.

Anyway, I just called to see if they would offer to do anything about it. Nope. Been told I'd have to buy out the contract at about £114 - which isn't too bad, only, why should I have to buy it out if it's not worked for 5 months and this automatically sending out a new battery has never happened?

Does anyone know where I stand with this? Should I just buy it out or is there something I can do with it?

    Im guessing you've asked to cancel the contract and they have said it will cost you £114?

    What did they the about the battery issue when you phoned them up?
