Landlord taking me to court, please help

I hope someone can help me, I was late paying my September & October rent
£700 per month, in October I was issued A section 8 due to owing £1400
I paid £1000
I have been summoned to court, I owe £1100, not 2 months rent
How is it possible when I did not owe 2 months rent, I thought I had to owe 2 months before landlord could apply

    Depends which ground(s) your Section 8 was issued on. Was it ground 8? Used when the rent is still in arrears on the date that the Section 8 notice is served and on the date of the hearing. Where rent is due monthly, at least two months’ rent must be in arrears. Possibly ground 10.....used when any amount of rent is due on the date that the Section 8 notice is served and is still due on the date that proceedings begin.

    Have you paid November's rent and December's rent?
  • But the landlord applied to court on the 25th November, I did not owe 2 months rent then

    LL can apply if 1 day late, but the court does not have to evict unless two months is owing. (they still can, but it's discretionary)

    Which ground(s) was your Section 8 issued on?

    Have you paid November and December's rent in full?
  • Yes december and november paid on time, landlord agreed I could pay off the rest over the next 3 months

    then there is no problem. He will presumably not proceed to court.

    and if he goes to court, and, as you say, you do no owe 2 months rent, his clim will fail.
