title deed

Hi
I was jointly owner with my friend on my flat . We bought this on 2010. We both lived in the flat for 2 years and then decided to change ownership to me since he is getting married. We agreed sale and I have transferred the money which he said. Also I have given case to solicitor to change title deed to my name. Since then I am paying mortgage and my family is living in the flat. The solicitor who is taking too much time to remove my friend's name from title deed since 25% of flat owned by ani two companies.Now it's has been 4 years and value of flat gone up. Now my friend is claiming ownership on this property. His name is still in title deed and my solicitor is not working properly on this case.All the documents signed by my friend is with this solicitor. I am not able to give the case to another one. Really heartbreaking to see my friend's attitude.Me and my wife hard worked to raise the money to give him. My ex friend signed deed of release to developer equity mortgage(which is the only document solicitor send to me).


Any court order can be obtained to remove his name from property?
Any help really appreciated. Thank you.

    if it's been 4 years since you bought your friend out of the flat, then you really need to raise a complaint with your solicitor!!

    Has he been sat on the money you've paid him for those 4 years?

    It's not clear whether "the" solicitor is acting for the OP and/or the other owner. Or what the reason for the delay is. Or why they can't get another solicitor involved.
  • Already complained against solicitor against legal ombudsman. But there was not much use.
    And now all the documents my ex friend signed is with this solicitor. So I have to be careful dealing with him.
    The other lawyers acts for Bank. They are saying they are waiting for some documets from company which is involved in 25% share. But this company has given their charges to another company. I tried to contact bank's solicitors to tell about this. But they are not willing to speak to me, but only through my solicitor. And my solicitor doing nothing :(.

    You should never have transferred money to your friend before the house was officially 'sold' to you.

    Imagine if you transferred money to the seller before any paperwork was done...?

    I really have no idea what you should do... but you do need to speak to a solicitor!
  • It sounds like you need to get your file from the existing solicitor, and find another solicitor.

    4 years is a ridiculous amount of time for this to drag on.

    If what you're saying is that you have complained about your current solicitor to the ombudsman - why are you still using them? Go to another solicitor.

    So lemme be sure this is clear...

    You jointly own a flat.
    You own 37.5%, your friend owns 37.5%, "a company" owns 25%.

    Four years ago, you wanted to buy your friend out.
    You give your friend the value of their 37.5%, straight to their account, but the actual ownership still hasn't been transferred, because this mysterious company are dragging their heels.

    Am I understanding you right?
  • He was a good friend at that time and when he moved out of the property we paid him the money even house was in negative equity since he paid towards mortgages for 2 years. Also we initiated the procedure to transfer the property. But never thought this will take ages.


    We can't change solicitor since all the signed documents is owned by them.
  • Yes you are right. Solicitors are saying that they are waiting for documets from different companies.
