Responsibility of car

Hello all,
I'm new here and this is my first post so I'm sorry if it's not done right. I need some advice regarding a car I purchased from a family member. It's my first car so don't really know the ins and outs of buying and selling.

The log book has been signed by both of us and sent off to the DVLA (as far as I'm aware). The seller had agreed to payments in installments so no money has been exchanged as of yet. Anyway, after sending the logbook off we agreed he could keep using the car until he sorted out his insurance on his new car which was only a few days. Now he has told me the car is faulty and wanted me to pay to fix it or just transfer the logbook back to him if I didn't want to fix it. I decided to just give him the car back as really don't want the hassle and to be honest think he just decided against selling it.

I'm now worried as the logbook has been signed over to me and could take weeks to come back am I responsible for the car? I've never had it and the seller is still driving it. I just don't want to be liable if he is driving a car in my name without valid tax or insurance.

  • The V5 document (log book) only details the 'registered keeper' not the owner of the car.

    Simply get a hand written bill of sale or transfer of ownership signed and dated by both of you and that will cover it.

    There are two parts to the form: you (the buyer) should have completed your own part, then you'd know it had been sent off.

    When the V5 is received by the DVLA the VED would of been cancelled and the previous owner refunded - so the car would of been unVED'd from the date of the transfer/sale.

    So you are now responsible for the VED, to cover yourself you will need to have something in writing to say the sale is cancelled or a new date for the sale and keep hold of this.

    Once the V5 is received by you complete it and send it back with the back-dated date of the transfer with the previous owners details.

    The previous owner will need to buy VED again using the reference number on the NEW V5 new keepers green slip.

    Or he could call the DVLA, if you can speak to a human, and ask them to cancel the transfer and send back the original V5.
