    We are retained by ****** Motors and write in regard to your email concerning the above vehicle (“the vehicle”)

    Please ensure all further correspondence is directed to this firm and not to our client.

    BACKGROUND
    Following your examination and test drive you entered into a contract on or around 3rd November 2016 to buy the vehicle, having an odometer reading of 120,088 miles and an MOT valid from 2nd November 2016. The contract is one to which the Consumer Rights Act applies.

    Subsequently you have reported the DPF requiring cleaning or replacing and you seek to recover the cost from our client.

    THE CONSUMER RIGHTS ACT 2015
    The Consumer Rights Act 2015 (“CRA”) provides that goods and in this case the vehicle, is required to conform to the contract in that it is of satisfactory quality (section 9 CRA) as considered objectively by a reasonable person taking into
    consideration its price and other relevant circumstances.

    In the current circumstances the vehicle was effectively 9 years old, had an odometer reading of at least 122,088 miles and cost less than 9% of its cost price when new. As a result, it is reasonable to expect to find some degree of wear and tear to the vehicle taking into consideration the age and price. The vehicle would not be expected to be free from defects and a person would anticipate that some defects in the vehicle might come to the surface sooner or later.

    As a result of the matters referred to above, in that the vehicle passed an MOT immediately prior to delivery, it conformed with the contract and our client is unable to consider your claim.

    You do have the right to refer this matter to an approved ADR provider https://www.tradingstandards.uk/advice/ADRApprovedbodies.cfm if you remain unhappy. However please be aware that neither we nor ****** Motors are under obligation to participate in Alternative Dispute Resolution.
