Pixmania - Tv returned under warranty now damaged in transit

I'm not sure if I'm in the right place but don't know where else to ask.

Last month I returned a TV worth £900 for warranty repair to pixmania. They ordered a company called Colibak to arrange the return who in turn sent Fedex to pick it up (and take it to France!!).

Fedex broke the TV and pixmania refused to accept delivery. After many emails and phonecalls Pixmania have told me there is nothing they can do for me now as Fedex have the TV and it is broken. Fedex say they can't help me as I am not the account holder and I should speak to the retailer.

I now have no money and no TV and no-one will talk to me. Pixmania whilst pretending to be a UK based operation (uk web address and phone number) actually only operate from France so I don't even know how would take them to the small claims court.

Does anyone have any experience in such matters? I know if this was a UK company I'd simply demand the refund or take them to small claims court.

    It is Pixmania who owe you and it's up to them to claim down the line, but I don't know the position regarding getting settlement from them.


    This is why I always buy from Richer Sounds. They are reliable, helpful, beat any price and I can collect in person, so no hassle with damage by third parties.


    My son once worked in the warehouse of a carrier and commented on the lack of regard for 'Fragile' labels, delicate items often being thrown into containers, onto conveyor belts or simply dropped.

    Absolutely - my contract is with Pixmania, I just don't know how to enforce this. There are only 2 English speaking people on the helpdesk. I asked to speak to the manager but he or she doesn't speak English.

    I used this procedure to get money out of a timeshare mob based in Eire. The judgement bit worked fine but it took a bit of persuasion before the local Sheriff (bailiff) acted. Even then they only chased for and obtained the amount originally owed - they ignored my e-mails asking them to chase the court costs and interest ordered by the local court. I presume that they were not used to dealing with enforcement of this type of claim.

    Even though I didn't get all that was due I was happy enough to get the amount I was owed so, to that extent, it worked well.

    If you paid by credit card, maybe you can make a claim against the credit card company.

    To the op: if you originally bought the tv using a credit card read the following:

    In particular note:

    Whether it’s in the UK, abroad or on a foreign website, Section 75 applies.

    This is a real boon, as often if you buy something using a credit card abroad it’s much more difficult to get in touch with the retailer. So don’t bother, simply make a claim directly against the card company.

    Well I used my Amex card through PayPal. PayPal wouldn't help, I could try Amex....
