insurance refund after liability decided?

I was involved in a Motor incident which went to court. The Judge decided in my favour.

In the time I was waiting for the hearing date my insurance came up for renewal, I asked at the time and they said they have to put the incident down as fault due to the fact they work on the worse case outcome (fair enough). Now it is a non-fault claim do they have to refund me the difference in the years premium between the two.

I will ring them to ask but before I do just wondered if a) they have to do this, b) I am relying on the goodwill of the person I speak to or c) I have no hope.

  • It's all to do with whether your insurance company has paid out and subsequently recovered from the guilty party and their insurers. If this remains outstanding or in limbo then they might not be able to help. It also depends on whether you had any No Claims Bonus to lose in the first place
  • Hi there. I have just registered today and am in a similar position to iammumtoone except I was 10% at fault.

    I have a multicar policy and the car in question at the time had 3 years no claims non protected bonus, although one of the other cars had a protected bonus. The crash car was written off but I still have multi car.

    All parties have paid and my insurance company said that if I paid the 10% off it would reduce my policy payments (as they shot up like they did with iammumtoone). the 10% £430 so I would only want to pay it if it would make a difference but they cannot tell me how much because they cannot change the details as they are on some centralised database, but they said it would mean the claim is not down as a fault claim anymore.

    Just wondering if any of you have been in this situation before or know if it is likely to make a difference or not?

    You can find out what difference it makes by doing dummy quotes online.


    Do one with the claim in your history as no fault (ie no payout by your insurer after you repaid their outlay) and another with the claim as a fault claim and reduced NCD and see whether it's cost effective to pay off your insurer.


    Irrespective of this, you can now pursue the third party to reimburse you 90% of your uninsured losses (eg excess/hire car/loss of earnings etc)
