in IVA & DRO
Hello all.
I currently have an IVA with Harrington Brookes. I have just completed 2 years.
I have just submitted all my bank statements etc, and explained a few things on there.
Basically, every so often, my ex partner has paid some money into my bank account, to help out with child care etc, and for any bills that have been in her name. We are still on good terms as we have a little boy.
They ahve question and question and questioned this again and again and again.
I also explained I am away with work, in France which I literally am, anyway i got a couple of calls for a second or two, as though they are checking if I am abroad or not by the dial tone. Which is normal by the way.
I have shown all of my bills come to the amount I pay every month. and I do work over 40 miles away, so thats 80 miles a day in fuel.
However the lad dealing with the case, just seems to question everything, and has now said, he will speak to his supervisor and get back to me soon.
I feel they are likely to cancel this and I will have paid £3000 for nothing. I could of used that to go bankrupt, however now, I earn slightly more money, so I doubt that will be an option.
When I had to move house, there was only one place that would take me due to my iva , but wanted 3 months rent and double the deposit.
I explained this at the time, but were unwilling to stop the payments for a while.
My ex partner used my Paypal to make purchases, but always put it back, clearly on the statements, but they say this is an issue aswell.
are there any suggestions if this should get cancelled.
Oh also, when first applying, I asked about a DRO, but they said the amount exceeded the lmit, so went for an IVA. Then I get informed that I was actually under it but it was too late.
thankyou

Over zealous case worker would be my guess, but try not to be too harsh.
I.P's act as "honest broker" between creditor and debtor, and cannot just ignore extra income, they have a legal duty to question it otherwise the system would just fall down. I am not sure what you mean by bills that are have been in her name though, are these debts that are in the IVA? Where extra is received because of extra child care needs, keep the receipts, or point out the extra expense on any bank statements. The paypal issues are the same, but they are right to query them. The Official Receiver certainly would if you were in BR, so, again, do try not to be too harsh.0 -
Hi,
They won't cancel the IVA, only non payment by yourself can do that, or if you are totally dishonest with them.
I had a similar issue, my brother used to put money into my account to pay his bills for him, I just wrote on the statement what the payments were for, they were never questioned.
In future just don't have any of these "transactions" showing in the 3 months prior to your annual review, it saves a lot of hassle.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
