Water damage-who is liable?

hello,
I was wondering if anyone here could be of help in a water damage claim against me?

My downstairs neighbour is making a claim of water leakage in her bedroom wall which is just beneath my bedroom wall.We had torrential storms here recently with major flooding. According to the communities' surveyor, the water gushed down from a poorly built roof (no gutters, nothing to catch water)in the next building onto our terrace which then caused water damage to my bedroom wall before continuing further down to said neighbour. How do I go about proving that the adjacent building's roof is the origen?

Our neighbour has contacted our assessor who is coming. What should I expect and how to prepare myself?
Any suggestions welcome,
Thanks

When the assesor comes you tell him you are a victim too.
Provide what the communities surveyor said.
You are both a victim of third party poor built. You cannot provide protection from something caused by third party.
Have you contacted your insurance company? If you weren't going to, you should. They will fight the claim against them below and damages from the third party (ie next building).
There might be an outcome that it was "act of god", ie something caused by extreme weather or natural rare occurances. If the third party proves they built correctly.
But either way-I would fight that it wasn't caused by me-poor maintenance on my part.

Thank you, Any for your reply. The fact that the third party has built a faulty roof has to come into the equation as you well state. I also think the fact that this entails the general building's structure as well but that's a whole other kettle of fish. Thank you for your suggestions.

You are in Spain? You would be better posting your question on one of the many ex pat forums.

Insurance cover & rules in Spain are often not what you might expect. You might want to try BritishExpats.com
