Notice to keeper 1 month after the event...

I got a PCN from Britannia a couple of days back and noticed that the date of notice was one month after the date of contravention. I seem to recall reading elsewhere on this site that they need to send one of these within 2 weeks of the offence so does that make this PCN invalid? For what it's worth I am guilty as charged in that I didn't pay, although this was because their machine was so damned confusing. On the back of the PCN are pictures of my car arriving and leaving the site with times on the camera pics...Can I appeal or do I just have to suck this one up?

I tried to put up a pic of the PCN but I'm not allowed to link it as a new user...

    poor brittania , could not organise a %%%%up in a brewery

    seem to be in trouble with the DVLA quite often

    lets rub some salt in the wound

    send a LETTER to the DVLA , as per this template , find out WHEN they got your info

    No there was no windscreen ticket, just a letter in the post earlier this week. They took a pic of my car entering and leaving the site...

    therefore it was done by the ANPR method and a month is way to long to claim keeper liability

    this is providing its not a lease/hire type car , and the V5 is registered to you at the same address

    why not sit your ducks in a row? get evidence from DVLA that they have failed to get data in time , if they continue with keeper liability , report them to BPA and DVLA


    as they say at tesco , every little helps (to shut them down)

    Presumably if the DVLA say that Britannia accessed my data too late then I just include that in my appeal? What is the time limit for them to access the data?

    both your appeal and in complaints! , always refer to yourself as the keeper , do not admit to being the driver


    edit: by ANPR method , it has to be RECIEVED (not posted - RECIEVED) within 14 days starting the day after the incident

  • Got this back from Britannia in response to my appeal:

    Thank you for your appeal received on 08/12/2016 regarding the above detailed Parking Charge Notice.
    We have reviewed the case and considered the comments that you have made. This appeal has been
    considered in conjunction with the photographs and any evidence provided. Our records show that the
    notice was correctly issued as your vehicle was parked in breach of the Terms and Conditions of the
    Car Park.
    The Parking Charge Notice was issued to your vehicle because your pay and display ticket had
    expired. The ticket obtained was for a stay of 30 minutes where as this stay has been recorded at 1h
    11m.
    We are members of the British Parking Association (BPA) and we follow their Approved Operator
    Scheme, Code of Practice at all times. Section 13 – Grace Periods, details that once the parking
    contract has ended (ticket has expired), we must give the driver a reasonable period of time to leave
    the car park. We have a 10 minute grace period at this car park. If the driver has not purchased another
    ticket or left the car park by the time the 10 minute grace period has been reached, a Parking Charge
    Notice will be issued, for breaching the terms and conditions of the car park.

    It is not a requirement for the Parking Charge Notices issued to you, that we must notify you within 14
    days. This only applies if we refer to the Keeper Liability provisions in Schedule 4 of POFA 2012, when
    we issue a Parking Charge Notice. As we did not, we have 35 days to notify you of the Parking Charge
    Notice.
    Britannia Parking have made no assumptions as to the identity of the driver, we have written to you as
    the vehicle keeper to inform you of any outstanding contraventions on your vehicle. Should you wish to
    transfer liability, please provide the driver's details and we will amend our records. Please be aware the
    identity of the driver does not affect the validity of a PCN.
    You have now reached the end of our internal appeals procedure.
    You now have a number of options from which to choose:-

    1 Pay the Parking Charge Notice at the discounted rate for a further 14 days.Please note that after this
    time the discounted rate will no longer apply and the full Parking Charge Notice amount will then be due
    within 14 days.
    2 If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery
    procedures and may proceed with Court action against you.
    3 Make an appeal to POPLA – The Independent Appeals Service. Please note that if you wish to
    appeal to POPLA, you will lose the right to pay the Parking Charge Notice at the discounted rate, and
    should POPLA’s decision not go in your favour you will be required to pay the full amount. If you opt to
    pay the Parking Charge Notice you will be unable to appeal to POPLA.
    The POPLA service is only available in England and Wales.
    You must submit an appeal to POPLA within 28 days from the date of this outcome letter, by submitting
    an online case at (not allowed to post the link) Your POPLA verification code is xxxxxxxxxxx.
    By law we are also required to inform you that Ombudsman Services (not allowed to post the link)
    provides an alternative dispute resolution service that would be competent to deal with your appeal.
    However, we have not chosen to participate in their alternative dispute resolution service. As such
    should you wish to appeal then you must do so to POPLA, as explained above.’
