A0 & Beko 8month fault repair failed, Refund possible?

Hi
I purched a dishwasher Jan 2016, from.AO appliance online- 12 month warrenty with beko. in September it produced fault, asked AO for copy invoice, and I then contacted beko for repair
.Item repaired by their contracter, but repair failed last week December which with I believe is the same fault. Have written to AO quoting Sale of Goods act asking for refund. They have rejected my request stating
'Although we'd love to be able to return all faulty appliances, the warranty is a repair warranty and this is the resolution option that we would take at this stage.'.......

Item failed now twice In less than year...want rid....suggestions help please, to get resolution processed quickly

  • SOGA was superseded by the Consumer Rights Act in October 2015, quoting an out of date act isn't likely to worry them too much. Suggest you read up on your rights using the correct legislation.

    As above, you need to go back to them and quote the relevant parts of the CRA.
    (5)A consumer who has the right to a price reduction and the final right to reject may only exercise one (not both), and may only do so in one of these situations—

    (a)after one repair or one replacement, the goods do not conform to the contract;

    BTW, it doesn't necessarily have to be the same fault (another misconception).
  • I can see one thing that may cause problems in trying to obtain a refund.
    The OP stated that they only asked AO for a copy of the invoice and that they then asked Beko for a warranty repair. If this is the case and AO didn't even know about the problem, they could argue that they haven't yet carried out a repair.

    The CRA is very specific about rejection and repairs and the trader must have either have done the repair themselves or arranged for it to be carried out.
    If they knew about the fault and told the OP to contact Beko then there shouldn't be a problem, but if not, who knows.
    (6) There has been a repair or replacement for the purposes of subsection (5)(a) if—

    (a) the consumer has requested or agreed to repair or replacement of the goods (whether in relation to one fault or more than one), and

    (b) the trader has delivered goods to the consumer, or made goods available to the consumer, in response to the request or agreement.

    (7) For the purposes of subsection (6) goods that the trader arranges to repair at the consumer’s premises are made available when the trader indicates that the repairs are finished.

    Bear in mind though that any refund can be reduced to account for usage ... you're not entitled to a full refund.
