Holiday entitlement and Christmas

Good Afternoon


I started working for a new company end of October, my holiday runs from February until end of January. I work p/time all day wed/thur/fri, so they said I have four days holiday until the end of Jan but because they close down everyone has to save 3 days for that, so I have lost 3 days holiday, surely it should be pro rata like my holidays.

    The company can choose when you take your holidays, in this case they say you have to take 3 of them during their shutdown.

    If you are off three days then three will come off your allowance. A day is a day however many you are due.

    When you say pro rata remember that full timers will be using 5 days to get the week off, you are only using 3 because you don't work Mon or Tue anyway.

    You haven't 'lost' 3 days' holiday as you won't be working those 3 days, you will be on holiday!

    Like (almost) all workers, you have a statutory entitlement [STRIKE]to 33 [/STRIKE] of 28 days' holiday a year, pro rata. This statutory allowance includes an allowance for bank holidays. Your employers have calculated that your entitlement until the end of Jan is 4 days. Be very clear, employers are allowed to dictate exactly when workers take their holidays.

    In this case, 3 of your 4 days fall when the company is closed, so the company is requiring you to take those days then. Simples! Unlucky for you, but when Christmas falls on a Mon or Tue you WON'T lose a day's holiday, as you will already be off.

    Itll should be a little over 4 days. Not sure what youre on about pro rata, it is.

    If the business is shut, you normally have to take your holidays then (christmas/BH/easter etc). A business can stipulate when you take holidays as to suit their needs.

    What days are actually closed down?

    No they only have to use 3 as well.

    Where did you get the figure 33 days from? Stat min entitlement is 28 days which can include the bank hols.

    I thought it was 28....has it increased?

    26-30 dec and 2nd jan, everyone else has to use three also
