IVA from first marriage debts

Options
So I have an IVA currently in place and have been for 3 years. My ex husband went bankrupt quite soon after divorce so everything was then my responsibility. I have another 3 years to pay. I got married 2 years ago and my husband now have said he don't want his wages included in the income for the financial breakdown. Is he expected to include them as we are married?

Help we are constantly arguing about it and I feel at the end of my tether with it all.

  • Always tricky this issue.

It can be looked at a number of ways.

Full disclosure, all income taken into account and full allowances made.

Pro rata, whoever has the highest % income is expected to pay that % against bills, meaning a fair deal

    50/50 split

Occasionally, a new partner may opt to make a contribution towards bills by a one off "rent" payment per week or month.

What will not be allowed is an assumption that your husband does not contribute anything at all towards household bills, and I assume that that is not the case anyway?

As a rule of thumb, most I.P's will use whichever calculation works best for you, but depending upon which I.P. you have you may be expected to provide proof of his earnings. Again, this does not tie him to paying your IVA but does make sure that creditors get a better return from your improved home financial circumstances.

    Hope that helps.
