Right of access

I'm in the process of buying a house and the access to the garage and garden is down an unadopted alleyway/road, which runs parallel to the side of the house. there are a number of buisness's that have yards that back on to the alley. everyone seems to use it without any problems. is there anyway of getting absolute right of access, or do i need to get some kind of policy to protect me just in case something happens regarding access?

    Is it privately owned? That's not the same as unadopted.

    If privately owned, who owns it?

    Have you read the Title documents? Is a ROA mentioned?

    Are you doing the conveyancing yourself? If yes, this may be time to stop. If no, this may be the time to speak to your conveyancer.

    What did the owners of the neighbouring properties/businesses say when you asked them?

    hi, doesnt seem to be owned by anyone......ive been talking to my conveyancer, im just waiting for them to come back to me......just wondering what my options are at the moment. coincidentally my conveyancers rear of their building access out on to the alley!!

    Have you actually done a Land Registry Map Enquiry?

    Until you know the current legal position how can anyone advise on options?

    So I ask again - have you read the Title document? Do that before asking further.

    And speak to the neighbours.

    Well I've read the title documents of the property I'm looking at and the alleyway isnt included.......are you saying there will/may be title documents for the alley way?

    Someone will own this alley way and you need to know if you have legal right of access over it. It should say in your title documents if you have a right of access over the alley way. If it doesn't then you probably don't have one which means that you don't have the right to access the garage.

    All land is owned by someone.

    The difficulty may be identifying who if the land is unregistered. but until you look you won't find!

    You can look at the Land Registry map for froo and itvwill show if land is registered or not. If it is registered it is £3 for the register (that is who owns it) and £3 for the title (the map showing approximate boundaries). If the records are electronic then once you pay they can be downloaded within moments.
    Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)

    Or (rather than duplicating work and costs) just leave it to your solicitors. If they adjoin the lane then they might even have the answer in their own titles.
