Tenancy reletting fees and deposit Help!

Hi I need some advice if possible. Last july me and my partner started renting a property which was 725 pcm rent which we paid am 825 bond on. We split around 6 months later and the tenancy was put into my name at a fee of £40. I recently found a home the same size for 620 pcm which as a single working parent with no help towards rent I was obviously interested in ! Anyway I spoke to my estate agent who said there would be a £300 fee to relet the property which would come out of my bond. So they put the house on the market 5 weeks before I moved outwith the original pictures and information from when I viewed the property over a year before... anyway they had 2 viewings within a week and a half and the second person has taken the property (which they will be paying the administration fees etc to start a new tenancy) so I have moved out and the new tenants are moving on so they have had no financial loss in rent. I then get an email today saying that they have been to the house over the weekend and cleaned it and are now requesting another £150 for cleaning costs ?! I cleaned the house when I left (obviously there will be general wear and tear) and the cooker I would agree maybe needed something a bit tougher but it was in a good condition.. I just feel slightly like I've been massively overcharged by the estate agent and am now looking at only 375 back out of an 825 bond ! Any thoughts or advice? I am going to get a detailed invoice on exactly what the cleaning costs were if they use an external company but if anyone can shed any light on these matters it would be much appreciated!

    * if new, what happened to the deposit? Was a new inventory prepared and did you sign it?
    * Either way, date tenancy started?

    presumably this is because you wanted to end your tenancy early, yes? See Qs above!

    * date?
    * conditions? Just the £300?

    Either this tenancy started when you and ex first moved in, or it started when ex moved out. Which? It makes a difference.

    Was there an inventory from when the tenancy started (whichever date it was)? If yes, the condition described in that is the condition you should leave the property in. Did you? If no such inventory from the relevant date, the landlord will have difficulty proving you've left it in worse condition than at the start (whenever the 'start' was).

  • Hi sorry I thought I'd put info in as I've never done It before.
    Tenancy wasn't ended when partner moved out the tenancy was switched from a joint to a single with the same date it was due to end July 2017 (started July 15) as was original joint Tenancy no new deposit paid just original and paid the 40 fee to change the tenancy from joint to single. Yes the fee of 300 was as I asked to end the tenancy early and just described as reletting fee to find a new tenant (just wondered why so much when clearly easily found new tenant) And no new inventory was done when partner moved out just one at the original start date and left house in good condition cleaned etc which is why I want to ask for details of what cost 150 to clean . Sorry I hope this makes more sense now! Thanks for the link
  • Have you applied for housing benefit? About a million working people get HB paid, maybe not the maximum but some. Check on gov.uk under benefit entitlement and see all benefits you may be up for.

    The landlord had no legal obligation to agree an early surrender with you and can impose any terms he likes i.e. the £300. So you're just going to have to suck that one up. There will have been a cost to the landlord to advertise the property.

    1) your tenancy started in July 15 so the relevant inventory is the one dated July 15.
    Was there one?
    Have you a copy?
    What does it say?
    See my earlier link re cleaning.

    2) Your tenancy runs to July 17. You wished o end it early.
    The landlord can charge whatever he wants to agree o end it early.
    You can either agree to pay, and end the tenancy early,
    Or refuse to pay and maintain the tenancy till July 17

    3) In a 2 year tenancy, there may be a 'Break Clause'.
    Read the tenancy agreement and check.
    This is an alternative way to end the tenancy, if it exists.
