Napier Parking Ticket

Hi All,
I'm wondering if the good people here can offer me some advice about the inconsiderate and money hungry company called Napier Parking. Last month I went for my sister's birthday in Milton Keynes at the Premier Inn at Willen lake, I came all the way from Derby. It was an exceptionally windy day and was drizzling a little. I purchased a ticket and displayed it on my dashboard. However, it must have been displaced to the seat by the wind when my 4year old came down from the car (he was the last to come out). Admittedly, I did not double check that it was still on the dashboard because we naturally tried to escape the winds and rain as quickly as possible by taking cover in the shelter of premier inn. When everyone was safely away from the treacherous weather, I locked the car electronically from a distance and failed to see the ticket had been displaced.
What greeted me on my return? A parking ticket! which by the way may have damaged the windscreen as the gum or whatever used has refused to come off. Who will pay for that damage? I wonder.
Anyway, I appealed to them narrating the above circumstances (with evidence of the ticket) believing I was contacting actual human beings. Turns out it more than likely wasn't humans but inconsiderate robots. I appealed 9pm the same day it happened and got a rejection before 9am the next morning.
I appealed it further to an independent body they referred me to who despite expressing sympathy for my case dismissed my appeal because the ticket clearly was not displayed correctly.
I have now received a letter which I find threatening. It contains a recent court judgement in their favour, the possibility of ruining my credit history, taking me to court etcetera all for £80.
Not only is the amount ridiculous, it is the sheer inconsideration from their part. Clearly, high winds are an act of God which I have no control over and to insist that I had to make sure it was still displayed correctly in such circumstance is sorcery at best.
I have no intention to pay it but a bit concerned about it being handed to a debt collector and ruining my credit history. Going to court is the least concern as I don't see how a reasonable judge will allow such treachery stand.
Any advice would be useful please.
Thanking you in advance.

Oh why did you try IAS? I so wish people would find us earlier, you had no chance and should not have tried IAS stage. They are not 'sympathetic' at all. It is considered by many here, to be a kangaroo court.
Napier try few court claims but of they do it's defendable. And after all, it's only a dispute over £80 plus maybe £50 costs all told so you may as well fight it now you are here getting advice (better late than never). Napier have been known to 'assign' some of their PCNs to MIL Collections and if that happens it's easier to defend.
So, sit tight and come back if you get a court claim. Be aware, this is not easy - a judge IS likely to side with Napier unless you defend it properly and robustly, they will not consider mitigation any more than the IAS would, you were on a hiding to nothing and this will not be your defence. Other issues can be argued though, if needed, and it depends if it's Napier or MIL who try.I have no intention to pay it but a bit concerned about it being handed to a debt collector and ruining my credit history.
You only get a CCJ on your record if you lose at a court hearing (or ignore court papers) and then refuse/overlook paying for 30 days after an Order from a Judge. Not going to happen, is it? Debt collector letters are nothing.
Sit tight.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You certainly picked the wrong PPC in this case.
Not wishing to be a harbinger of doom, but you might want to read this case http://www.debtrecoveryplus.co.uk/cms/uploads/judgement.pdf
You will need to form a decent defence based on non-sticky tickets and some regulars may point you in the right direction here.0 -
