INSURER WONT REFUND REMAINING PREMIUM - Car written off non-fault 11mnths policy left

I had a car accident if Nov 06 (thanx 2 all of you that helped me with everything then)
It was a non-fault accident, the 3rd party has admitted liability (I have in writing) I recieved money for my car and injuries, so the case is settled.
My policy i 3rd party fire&theft only so my insurer paid nothing to cover the costs of the accident.
But Fresh/HSBC still will not refund me any of my premium which I paid 12 months in Oct 06 (£300+), therefore I have only used 1 month.
They have stalled me and stalled me telling me they could do nothing till it was settled ( it was in March) then I had to send the letter of 3rd party admitting liability (I did) Then a covering letter (i did) each time I rang they still hadn't cancelled my policy, they said they wouldn't unless I put it in writing ( i hand wrote, faxed and posted. ) Then they wanted proof my car was scrapped, I sent the the top of the letter that I was sent with my salvage cheque attached, this had the salvage companys name and contact details, the scrap value and my car reg. This still wasn't enough, I had now had to get the engineers report to prove again the car was off the road, with the date of the accident. This was faxed on Fri, Tues and again today, each time I was told they would ring me when it was received - they never did - then when today they had received it i was told they would ring me back to see whats happens next - they didn't! i rang them and the person I was dealing with had gone home and they can't find the stuff i faxed so they will ring me back 2mro (BUT WILL THEY!!) AND THEY POLICY HAS STILL NOT BEEN CANCELLED!!:mad: :mad: :mad:
My questions to you lovely helpful :A people are
* Am I entitled to 11 months premium back? (£288)
* If not what am I likely to get? One of my many phonecalls I was told I was looking at £130ish Why?
* Did they really need all this information from me?
* Do I have resonable grounds to complain that it has taken me 10 months & I still have no money back?

No. You suffered a claim and therefore the premium for the complete year is due.They have stalled me and stalled me telling me they could do nothing till it was settled
This is correct. If it wasnt your fault, then you could get the premium transferred to your replacement vehicle.

No. In this time you have no doubt incurred costs and you will be able to use your legal cover (assuming you have it) to claim back your costs.I am an Independent Financial Adviser (IFA). I forgot to put in, I was 3rd party fire & theft, so all claims were against thier insurer, my insurer paid nothing, They wouldn't transfer to my new vehicle as the case was not settled. I will edit above to show about being 3rd F&T
i was 1st told i could claim back the 11months remaining from the 3rd partys insurer by putting it as a cost of the accident Minster Law said I could not do that. The case has been settled so they will not deal with anything moreI'm getting older, and lifes getting harder!:mad:0 -
As I see it, premium refund would be due from the point when you first requested it. Most insurers publish a scale of rebates in the policy booklet so check in there.
Agree it seems to be a case of poor administration. Suggest you escalate the complaint (procedure will be in policy book) and add a sentence to the effect you will involve the financial ombudsman if the matter is not resolved quickly.
From now on I would put everything in writing (email and back it up with a posted letter).0
