Credit Card Agreement

I asked for an original credit card agreement from my creditors only 1 company responded, which looked like a photocopy which someone in their bedroom and cheap printer has made up.

Question is when you sign up for credit is their a proper credit agreement like an original not photocopy which is signed in ink?

For example company when providing ID and proof of address don't accept photocopies and some ask it to be certified by a solicitor is it the same concept that these banks should be adhering to?

Also, if they fail to provide you with a credit agreement when asked or even advise you on how to obtain one or sent any request forms is your debt still enforceable by courts? I would imagine the judge would rule well you didn't provide a credit card agreement which he/she wanted therefor dismissed?

    It can be a reconstituted copy. Doesn't need to be the original - just the terms that were in force.

    Or you could just accept that you spent someone else's money and concentrate on ways to make repayment arrangements, rather than trying to find a technicality to wriggle out of your debt....

    It's fairly simple, stop spending other people's money if you can't afford to repay it and be very wary of anyone who tells you otherwise.

    Its called the law and banks are not following the law. The law protects us financially as well. I have my reasons.

    They never sent me a copy. Funny how they have not sent me one after 3 requests guess they can't be bothered following the law.

    and the law says that they don't have to provide the original, the photocopy is fine. If they don't have the original anymore they can produce a reconstituted one that has the T&C from the time and is a "fair copy" but is allowed to omit such as bank details and the signature box. If it is trying to say you didn't sign, then it's a dead end as in law they don't have to provide it and in fact many agreements now are done online so an actual signature is never captured, it's just digitally signed.

    You are correct, you are legally allowed to get either a copy of the original or a reconstituted copy to all your credit cards agreements, but have to pay a £1 fee for it. In these requests, did you pay the fee to them, or simply ask and not pay anything? How long has it been since you sent the requests, with fees, and have they replied.
    It can be unenforceable if they don't give you a copy, but if you haven't bothered paying the fee, don't moan if they don't bother proving a copy.

  • There seems to be spurt of people in this day and age that want to take all they can get for free, I find this appalling behaviour and do believe it is an age thing to, When I grew up I was taught that if you do borrow something you give it back in the condition it was borrowed and or paid in full, Is it a generation gap thing here whereby lots of people brought up in the 90's and onwards have no respect and a lack of morals to so that they just want a free ride in life ?
