Sue shop direct fiance

Hi guys,

apologies if in the incorrect place, a number of years ago i was a victim of fraud. one company was shop direct finance ltd.

although being helpful at the time, and removing the account and defaulted account almost staight away with the evidence that was complied they failed too take of the CIFAS cat 6 marker against my name.

3 years later i do a S.A.R because i keep getting declined credit with a 987/999 credit score. and was recommened by one of the police officers to do so.

i called them up and the apologised and removed it straight away, however im not happy enough with this, 3 years of being treated like a criminal and fraudster with no financial security or credit for something they "forgot" there words to do.

how would i work out an amount?
do i have any rights or leg too stand on?

    probably the most useful information you will get form here is to ignore your made up credit score. No lender will see it, or care about it as its a fictious number.

    What does your history show as that is what lenders will show.

    Bear in mind no 1 has a given right to anything so you could be rejected for anytning even if you think you shouldn't be.

    If i were you i would have checked my credit score before now especially once i'd been turned down for credit the first time. How much have you lost out financially ? Make a complaint, they might offer you some compensation, suing them is a bit extreme, unless you have bottomless pockets.

    I want to know how the situation came about where a police officer was recommending you do a SAR ?. Did you report to the police that you were being declined credit???.
    Or did the officer recommend that you do the SAR when the original fraud took place?, if so why did you take 3 years to do it?.

    I read the title wrong as if there is a shop called Sue Shop. Oh come on, it's possible.

    So where or to whom did you send the Subject Access Request and what was the result? What did they take off and from where?

    Nevertheless my unqualified opinion is that you missed the boat. After issuing the S.A.R. you would have received information in writing. Armed with that you would have entered the company's complaints procedure and after that if not satisfied you would have taken it to arbitration either through an ombudsman or CIFAS. As far as I can see from the opening post you haven't done any of that at all. In that case I should think that a court of law would throw it out and perhaps retire to the pub.
  • If you're going to sue the company, I hope you have a very healthy bank balance.

    It's not going to cost you fifty quid, it's going to cost you several thousand. And there's no such thing as Legal Aid for this.

    And you will have to show in court how you have been disadvantaged financially. That alone should cost a fair bit for expert testimony.
