Refunds.???

I went to my local furniture shop sept 2015. ( I know it's more than a year ago) Loved an item on display & asked if I could pay it up.... Not hire purchase "!!! Lovely manager said yes and sold me the item then and there and removed it from the shop floor... It's taken longer than I hoped... I'm now jobless n can't afford any more payments....I've paid more than half and the shop still has the item in their warehouse and my cash in there store...... They say I'm not allowed a refund even though I have not got the item yet....... I know the rules on refunds and on hire purchase agreements but not sure on this particular situation??????????

    What rule do you know on refunds?


    You are now in a position where you are not entitled to a refund as you bought it in store so the retailers policy, if any, takes precedence.


    You are now in a position where the retailer needs to mitigate their losses. This means putting the sofa back up for sale and selling it for the best possible price they can get. If the get full price then you get all your money back, if they sell at a loss then they keep the difference between the sale price and what you paid.


    They may even offer you store credit for what you have paid, this may very well be your best option but they don't have to.


    They can also deduct any reasonable expenses they have due to your breach such as advertising it for sale. They have also stored it for a year so they won't be best pleased at that and may even try to charge a reasonable storage fee.
