My OH had an accident. he was stationary waiting to pull into our old drive way. Little old man came round the corner too fast and hit him.

    No-one was hurt.

For nearly two years after we had calls. One even saying that there was a pot of money put aside and if he did not claim it would go to the government. (Complete rubbish of course )

Disgusting!!! My OH went mad. Insurance is there to help when you need it not to make a quick fortune.

Shame is that genuine people with whip lash will now be investigated and put the the rails just to stop horrible nasty idiots. Other shame is that naturally we are all paying the costs.

As for the car payout. I totally disagree. People don't overvalue their cars, people immediately look for the same car and when they can't find one of the equivalent standard, they then realize their payout is poor. You found two Almera's, one that was knackered (spares and repair) and one which I didn't look at on AutoTrader. I'm sorry but if my perfectly good car gets run up the !!!! by some inconsiderate driver, I expect the insurance to payout enough to either replace the car or mend it.

Some people do overvalue: most typically when they have spent large sums on repairs and think it adds to the value of the car.

My Oh had whiplash when he was stopped at traffic lights and was hit at the back by a bus.

Over 15 years later he wakes up in pain every morning and has just gone back to the GP to see if anything can be done. He has had injections in his neck, physio and been prescribed pain killers
    but nothing works.

When it first happened he just tried to work through it but it has got worse as he has got older.

Repairs do not add value to the car. Neither do cambelts, nor any of that nonsense. Ultimately, that's a risk you take. I once paid a small fortune getting a cambelt changed and then some further jobs only to be involved in an accident and the car be written off. I am aware that there is some leeway here.

HOWEVER, the money they offer you should realistically find you a vehicle in similar condition, without fault (assuming yours was) and with MOT. It's not remotely fair that the insurance company offers you enough to get yourself a spares and repairs banger with no MOT.

Firstly so sorry for your hubby. I have a problem with my shoulder it is a rotator cuff issue and the onset of arthritis so I know pain and know what it is like not to be able to sleep.I am now at the stage where they are looking at surgery for the rotator cuff but anything will be better than constant pain and thobbing that wont go away.

Not for one minute, one milli second do I want to belittle his issue but surly there could of been many other contributory factors.

For me I used to ride a lot, which means I used to fall off a lot. But I also fell down the stairs. Twice. I have also been in a car accident. So which is to blame ??? I honestly don't know. The accident we had so at just slow speed I did get jarred ( I lady backed into us in a car park ), I was stiff for a few days and in pain. But do I know absolutely that this was why I am in pain ? No.

Ps I really hope your hubby gets the help he needs. Pain is horrible. It eats away at you. Not only the physical side but everything else. I get ratty, short tempered, ( lack of sleep ) even sometimes have dark thoughts about just anything to take the pain away. Some days are better than others, so good luck and hope you can get it sorted.

For the insurance company yes they have to make money otherwise they will not be in business and not be able to settle your claim. But for the passengers, fraudulent claimants no.

If you are hurt, genuinely hurt make a claim that is what insurance is for. But if there is nothing wrong don't. I was talking about this last night and someone I know said that they had a accident and it was only them in the car at the time. "the insurance claim handler " was implying that he would get more money if his wife and children had been with him and that he should double check if they where not?
