No the driver is not a resident Northlakes. The driver followed some other vehicles and may have parked there when escorting their son and his friend (his birthday treat) where they may have attended a football match. The driver was totally unaware of any possibility of ''getting a ticket'' in the area the alleged offence took place. The driver parked with consideration for other road users. Does the driver really have any defence? The driver may have parked there but the claim is for a ridiculous £250!!!

everybody has a defence , these may apply

    contract law
    no locus standii
    poor and inadequate signage
    NTK failures
    CoP failures
not the same as the Beavis case
    legal costs not allowed

just a few of possible legal arguments that could be argued

see the recent parking prankster blog about this and reducing the charges (SLEEPWALKING)

bear in mind that nobosy should be stating what happened on a public forum where the enemy are watching

so THE DRIVER may have parked there

THE DRIVER may have gone to a football match

what do you not use on forums ?

"ME , MYSELF or I" , thats what , so edit your posts asap because I count several or a dozen or more "failures"

Do you think the driver should now contact Gladstones and ask for photographic evidence and also ask to clarify:
    a) If you are alleging a contract was in place by signage, please provide a copy of the contract and an explanation on how the charges arose
    b) If you are alleging the contract was in place by performance, please provide a signage map at the time of the incident
    c) Please supply a list of other documents your client will rely on in court, such as copies of photographs showing the signage in place
    d) Please supply a copy of your client's authority to issue charges on this land
There was no loss/damage caused whatsoever, parking was considerate and MPS is not the landowner.
Will this be defence enough in the case of possible further action?

The driver has actually returned the first court letter by ticking that the driver intends to contest the charge after advice from CAB and the driver has received today a completed Directions Questionnaire (Small Claims Track). What can the driver put in their defence that may help their appeal? And, the driver thinks it is residential parking on a housing estate.

If you have got the DQ then you have ALREADY put something in the defence box haven't you. I'm scared to ask...what was put in the defence box?

OMG what on earth 'advice' did the CAB give...I dread to ask that too. you are stuck with that defence now. Can't re-write it.

Oh no. In the defence box, the CAB told you to write denying any knowledge?

    No actual defence at all?

Yep. Deny any correspondence. I suppose that's not much good then. Is the driver stuffed now?

Almost certainly. Did the CAB tell you to do that, to put THAT in the defence box and no defence?

YOU MUST COMPLAIN ABOUT THAT ADVISER.
