Faulty TV bought under Jacamo account which is now under my IVA

Hi all,


I am just looking for some advice. I bought a TV from Jacamo (paid under my credit with them) back in March.
I then filed for and IVA in August, including my Jacamo account there.
I took the TV to an official repair centre and they agreed that the TV had a manufacture problem, but as it was going to take too long to repair, Panasonic wrote to me and advise me to go back and said:


"In response to your inquiry, I would inform you that given the fact that the repair would have take too long, Panasonic has decided to offer you an Uplift Number, in order to have the television replaced.
Based on the Uplift Number provided by Panasonic - JHXXXXX - the retailer (in this case, Jacamo) will be able to replace the television with a new one."


I then got back to Jacamo and explained the whole history. They keep telling me to wait, and that somebody will call me back.


Today, they actually said that they can offer me a refund (on my account) as my account. I said that I want the TV replaced, they then told me that a manager will call me today.


I want to know what rights do I have? do the Consumer Right work for this situation?


The TV was bought under a credit account, which I made some payments towards it, and now everything remaining on that account will go into my IVA, which I will continue to make smaller payments to it.


What can I say to the manager? Panasonic has told me that I can have a replacement.

    Just say you would much prefer a replacement (and if they don't have the same model be willing to accept what they offer instead).

    However you cannot legally insist on a replacement, so be willing to accept compromise if necessary.

    Well they obviously are not going to want to help you out and replace a television that you havnt paid them for, you havnt even stuck to the original agreement when paying them back.

    Just return the TV get a refund into your account which will pay off one of your debts. Asking for a replacement is just taking the p**s.

    If you pay off what you owe I'm sure they'll be more accommodating.

    I'm sure you can see their viewpoint though, you've not paid for the goods, under an IVA it's unlikely you'll ever pay near the full amount. Far better for them to credit your account, then you can ask them to close your account and use whatever is returned to you to buy something that you can actually afford.
